Tomorrow the Madras HC is to pronounce its orders on the OBC reservation issue for All India Quota seats in Medical education.
Here is a thread ...
1.State Govt.'s surrender 15% of UG seats and 50% of PG seats to All India Quota.
2. These seats are filled in Central Medical
Institutions on basis of 27% OBC and 22.5% SC/ST reservation.
3.However in State Medical College Institutions only the SC/ST reservation is followed and there is no OBC reservation for these seats
4. This has been the process followed since 2007
5. Political parties woke up to the anomaly that OBC reservation was not being given in the AIQ seats in State Institutions.
6.This matter has been pending in Supreme Court since 2015 though the candidate's challenge was related to the State of UP.
7. The issue is now being spun as if the BJP refusing to give OBC quota in Medical seats of AIQ.
8.Truth is,from 2007 neither did the Congress and its allies including DMK which were in power for 6-7 of these years nor did the BJP, in power since 2014, ensure this was done.
9. Centre has now told the Court that it is ready to give 27% OBC reservation in AIQ seats in State Institutions also. It seems inevitable that this will be done sooner than later as no one is objecting to it.
10. However TN Govt and all major political parties say that 50% OBC
reservation must be given in TN as that is the State policy. (Not the 27% as is Central Policy)
11. In any case this is likely to go to SC for final adjudication.
12. How political parties missed this issue for so many years is a mystery. Logically at least All India
reservation rules must hv been applied for AIQ seats.
13. But none of the political parties come out clean in this. UPA had the opportunity for 7 years and did not do it. NDA had 6 years and they did not do it either.
14. Also this issue has nothing whatsoever to do with NEET
as this is the policy followed for over a decade before NEET came into practice.
15. To give due credit it was the DMK that raised this issue now and moved the Court and everyone else jumped on board to avoid missing out on the credit or being seen as anti reservation
16. However the AIQ seats will be filled by those deemed OBC's from across India and not just those among the BC/MBC groups in Tamil Nadu. So this may not specifically help Tamil Nadu students as they will anyway hv to compete with OBC students from across India for seats in AIQ
17. My take is that OBC reservation of 27% must have been followed for AIQ seats all these years.That seems to have been missed out. As for 50% for OBC's that is for Supreme Court to decide as who has rights on seats surrended by States after they are given to Centre as AIQ .
