Jacob Ngarivhume, 43, a politician- who is the current President of Transform Zimbabwe political party.

For wanting to demonstrate against corruption, Ngarivhume is detained at Chikurubhi Maximum Prison after the Zimbabwe Prisons and correctional services removed him from Harare Remand Prison on 7 August 2020 without the knowledge of his lawyers.

Ngarivhume was arrested on 20 July on allegations of contravening Section 187 (1) (a) as read with section 37 (1) (a) (i) of the Criminal Law (Codification and Reform) Act, Chapter 9:23, “incitement to participate in public violence.”

Section 59 of the #Zimbabwe constitution provides for the right to demonstrate and petition. Ngarivhume was the convener for an anti-corruption demonstration that had been slated for 31 July 2020 but was later thwarted by the security forces.

Section 60 also protects freedom of conscience with (1)(b) clearly articulating the “freedom to practice & propagate and give expression to their thought, opinion, religion or belief, whether in public or private & whether alone or together with others.”

For exercising the constitutionally guaranteed rights, Ngarivhume was denied bail on 23 July by the Harare Magistrate court. Bail application at the High Court was also turned down on 7 August 2020.

At Chikurubi, Ngarivhume is being denied food and warm clothes. Ngarivhume does not eat sadza for medical reasons and @ZLHRLawyers whose lawyers are representing him said the ZPCS have said they only offer sadza.

Ngarivhume is a family man with two girls and 1 boy who still needs a father. ZimRights maintains that Ngarivhume did not commit any crime by inciting Zimbabweans to demonstrate peacefully against corruption.

If he did, bail is a fundamental right as enshrined in section 49 of the constitution that states every person has a right to liberty.

Section 49 (1)(b) states that the right to liberty includes not to be deprived of their liberty arbitrarily or without a just cause.

Section 50 Rights of the arrested and detained persons (1)(d) states that they must be released unconditionally or on reasonable conditions, pending a charge or trial, unless compelling reasons are justifying further detention.

The courts have not given compelling reasons on why Ngarivhume should continue in detention.

ZimRights, therefore calls on #Zimbabwe & the criminal justice system to guarantee Ngarivhume the right of personal liberty by ensuring that bail granting is not politicized.

Ngarivhume life matters. President Emmerson Mnangagwa has pledged to fight corruption, Ngarivhume’s desire was to contribute towards this vision of fighting corruption and make Zimbabwe better. Demonstrating against corruption can not be a crime.
