The manifesto, which used the motto, “The voice of the people is the voice of God, further notes that @edmnangagwa will uphold ethical governance practices that demand accountability, transparency, and responsibility in the management of public resources and the economy.
This indeed was a promising start for the multitude of Zimbabweans who had for decades witnessed high-level corruption among top politicians and government officials.

On the 18th of June, ZACC spokesperson Commissioner John Makamure was quoted by @citezw saying the commission had proposed a bill to protect whistleblowers who have been victimized for exposing corruption.

Chin’ono became more than a whistleblower as he exposed corrupt deals in government tenders in the procurement of essentials to fight COVID-19.

Chin’ono indeed deserved “the rich pickings,” but alas he was arrested. The sin that he committed was exposing corruption, which saw the awarding of procurement contracts without following the procedure including the Drax Health Ministry deal.

Hopewell Chin’ono: Journalism criminalised

Hopewell Chin’ono, 49, a Zimbabwean freelance journalist and award winning documentary film maker is expected to be languishing at Chikurubhi Maximum Prison until August 25 for tweeting about corruption.

Chin'ono was arrested and charged with "inciting to commit public violence" for tweets he had posted encouraging Zimbabweans to participate in protests on 31 July 2020.

He is said to have contravened Section 187 (1) (a) as read with section 37 (1) (a) (i) of the Criminal Law (Codification and Reform) Act, Chapter 9:23, “incitement to participate in public violence.”

On 20 July, Hopewell Chin'ono live-streamed his arrest before being told to put his phone down. His Lawyer Beatrice Mtetwa in a video statement showing a broken patio door said her client had been abducted.

Section 59 of the Zimbabwe constitution provides for the right to demonstrate and petition. Section 51 of the Zimbabwe Constitution provides for the Freedom of expression and freedom of the media.

Despite these rights, prosecutors accuse Chin’ono of posting various messages on his twitter account calling upon Zimbabweans across the country to engage in acts of public violence against the government on 31 July 2020.

The anti-corruption journalist, through his social media, supported an organized, peaceful demonstration against corruption. An exercise of guaranteed rights, section 60 (1) of the constitution provides for the freedom of conscience.

He was denied bail on several court appearances. On the 6th of August, High Court Judge, Tawanda Chitapi, denied him bail. ZimRights raised concern over the bail denial.

Magistrate Ngoni Nduna had previously denied him bail on the 24th of July, which prompted him to file an appeal with the High Court of Zimbabwe. In his ruling, Chitapi said the appellant had failed to demonstrate that Nduna had erred in his judgment, he could not interfere
ZimRights maintains that Chin’ono did not commit any crime by inciting Zimbabweans to demonstrate peacefully.

If he did, bail is a fundamental right as enshrined in section 49 of the constitution that states every person has a right to liberty. Section 49 (1)(b) states that the right to liberty includes not to be deprived of their liberty arbitrarily or without a just cause #FreeHopewell
Section 50 Rights of the arrested and detained persons (1)(d) states that they must be released unconditionally or on reasonable conditions, pending a charge or trial, unless compelling reasons are justifying further detention.

The courts have not given compelling reasons on why Chin’ono should continue in detention.

At Chikurubi, Chin’ono’s lawyers said he is surviving on biscuits and water is as he does not eat sadza for medical reasons. He had also been denied warm clothes.

Hopewell does not deserve to be at the notorious Chikurubhi prison for whistleblowing about corruption. By pushing the hearing of the bail bid to the end of August, there is an inordinate delay in bail determination.

ZimRights, therefore calls on #Zimbabwe and the criminal justice system to guarantee Chin’ono the right of personal liberty by ensuring that bail granting is not politicized. Chin’ono life matters. Journalism is not a crime.
