Once upon a time, Robert Maxwell, (whose daughter Ghislaine, is involved in the Jeffrey Epstein-Trump scandal) and President Moi got together and decided they would hive off Uhuru Park and construct a 60-storey tower.

1/
---A short thread---

nytimes.com/1989/11/26/wor…
2/
Just like with projects we are seeing today, the Kenya Times Complex would be financed by $200mn in loans guaranteed by the govt.

Proposed by Robert Maxwell, the British-designed complex would house a statue of Moi, Kanu party HQs, KTN, conference & shopping facilities.
3/
Prof Wangari Maathai immediately filed an injunction at the high court agains the project.

And in language eerily akin to that used by social media trolls today, Asst Minister John Keen quipped, 'I don't see the sense at all in a bunch of divorcees coming out to criticize''
4/
Prof Maathai's application for a permanent injunction was heard by Justice Norbury Dugdale, who dismissed her request, saying that as a private citizen, she had no locus standi to sue on behalf of the public.

He dismissed her application with costs.

kenyalaw.org/caselaw/cases/…
5/
Dugdale was the same judge who ruled in 1989 that the Bill of Rights as enshrined in the Constitution was “unenforceable”, thus undermining the judicial system. He also threw out Gitobu Imanyara’s bid to nullify Section 2(a) of the Constitution.
6/
Dugdale was a protege of CJ Allan Hancox, the fourth British CJ since independence and their salaries were partly paid by the British government.

Hancox ensured that political cases were heard by Dugdale, with most rulings in favour of the government.

So bad was the division caused that an LSK group consisting Nancy Baraza and Aaron Ringera sued the then LSK president, Paul Muite in a bid to stop him making political statements against the Moi Govt.

It all began in 1983 when the Kanu govt bought Hilary Ngweno's Nairobi Times, renamed it the Kenya Times and brought in Maxwell as a 45% investor in the venture.

Kenya Times was the first full colour paper, selling 70,000 copies a day.

9/
When Prof Maathai learned about the plans for the complex, she launched a campaign against the project.

One of those letters was published by the Standard, then owned by British tycoon, Moi crony and irredeemable thief, Tiny Rowland.

10/
The government through local govt Minister, William ole Ntimama proceeded to then lied that no part of Uhuru Park would be hived off

By that time a perimeter wall had been erected occupying what is now known as Freedom Corner.

greenbeltmovement.org/node/910
11/
Ntimama even praised President Moi as “the greatest environmentalist…recognised internationally as the protector of environment”.

He went on to add: “Greenbelt Movement is seriously bogus…it is conning the international community to get funds for unknown reasons”
12/
John Keen then layered it on:

“The complex is for the benefit of the children of Kenya… I do not see why a bunch of divorcees, women of no standing at all should come forward to criticise the efforts that are being made by the government,”

Sound familiar?
13/
Long story short, international condemnation brought on by Prof Wangari Maathai's resistance and that of other crusaders brought the project to a halt in February 1990 and Uhuru Park was saved.

14/
President Moi never forgave Prof Maathai and his regime continued to brutalise her for years thereafter.

He even called her “a mad woman” who was “a threat to the order and security of the country”.

She never relented, and eventually won the war.

As for Maxwell, a former Labour MP, who was faced by mounting pressure over the financial position of his Co.s, his body was found floating in the Atlantic (after disappearing from his yacht) on the day before he was to meet with the Bank of England

theguardian.com/business/2018/…
16/
Secretly, Maxwell had been plundering the Daily Mirror’s pension fund – of which he was the proprietor – to support his other failing businesses. In total, more than £400 million was missing. Maxwell became known internationally as the archetype of a criminal tycoon.
17/
His daughter Ghislaine, (after whom he named the yacht-The Lady Ghislaine) was recently discovered hiding at a luxury mansion in New Hampshire, US.

She's been accused of human trafficking alongside Jeffrey Epstein.

“In the course of history, there comes a time when humanity is called to shift to a new level of consciousness, to reach a higher moral ground. A time when we have to shed our fear and give hope to each other. That time is now.”
--Prof Wangari Maathai

As James Bond villain Auric Goldfinger one quipped, once is happenstance, twice is coincidence, three times is enemy action

Even before Covid-19 hit, the economy wasn't doing very well and looking back, it's been rather rough for the formal sector in many ways, with companies shutting down and thousands of jobs lost.

1/
Here's a quick look how things have played out...

---a thread---

In May 2013, it was reported that Mama Ngina was Kenya Power's 4th largest individual shareholder with 2.2mn shares trading at Sh16.55 a share.

After 7 years of mismanagement and fraud, KP's shares now trade at Sh1.90 with Sh25bn+ lost in value.

businessdailyafrica.com/corporate/comp…
3/
Transcentury, founded by Kibaki's Muthaiga pals, listed in 2011 at Sh50/share (Sh13bn) and issued an $80mn Eurobond.

Then TCL got into RVR & Kibaki left power.

By 2013, the shares were at Sh35 and now trade at Sh1.80 (Sh675mn) with plans to exit NSE.

A short story about power production and Kenya Power's unending woes.

1/
In 2013, the Jubilee government set itself an ambitious target of growing the installed power capacity to 6,765MW in its first five-year term.

--a thread---

businessdailyafrica.com/news/Jubilee-g…
2/
In his critique of the power generation target written in September 2014, David Ndii stated thus:

"The long and short of it is that the belief that 5000MW will bring investors in droves is as fantastic as John Frum’s second coming."

nation.co.ke/oped/opinion/b…
3/
But in a rather entertaining rejoinder (which stated that Nairobi produced 60% of Kenya's GDP), Bitange Ndemo argued that if South Africa had 52,000MW of installed power, then Kenya could certainly do with 5,000MW more.

Former Nakumatt CEO Atul Shah has failed to stop Bank of Africa from auctioning his personal property worth Sh2bn over loans to Nakumatt.

In February of 2001, a businessman named Humphrey Kariuki sought the protection of the courts claiming he feared the police might try to frame him by planting narcotic drugs in his premises.

1/
And so began the saga of Charterhouse Bank

---A Thread---

webcache.googleusercontent.com/search?q=cache…
2/
See, Mr Kariuki was a signatory to an account held by Crucial Properties Ltd at Charterhouse bank (CHB) that had received a Sh2bn ($25mn) transfer from Lichtenstein, attracting the interest of both local law enforcement and the FBI.

nation.co.ke/kenya/news/ten…
3/
The FBI got involved because when Crucial Properties initially indicated that the $25mn had come from Jersey, the CBK's fraud investigation unit assumed that it was New Jersey, USA, and alerted the FBI🤦🏿‍♂️

Since money laundering was not an offence then, the case was dismissed.

About 60% of Laikipia - Kenya's 2nd most important wildlife area after the Mara - is owned by cattle ranches and conservancies.

The area is also occupied by local pastoralists in greater need of fast dwindling pasture and space.

Crisis looms

“For the first time ever, you get that vibe that you’re a mzungu — what are you doing here? It’s a bit grandiose to think we can continue to live like this when thousands of people out there don’t have any land”

Then there’s Northern Rangelands Trust run by Ian Craig & covering 10.3mn acres

“The local community remains highly suspicious of NRT’s intentions, with many feeling that it is more interested in securing minerals-rich sites within the conservancy”
