Oof. EU post meeting statement on UK Internal Market Bill - remove the clauses which break international rules by the end of the month or we'll take legal action against you: ec.europa.eu/commission/pre…
Vice-President Maroš Šefčovič: "The EU does not accept the argument that the aim of the draft Bill is to protect the Good Friday (Belfast) Agreement. In fact, it is of the view that it does the opposite."
"By putting forward this Bill, the UK has seriously damaged trust between the EU and the UK. It is now up to the UK government to re-establish that trust."
"The Withdrawal Agreement contains a number of mechanisms and legal remedies to address violations of the legal obligations contained in the text – which the European Union will not be shy in using."
At pretty much the same time the UK Government published details of the legal argument underpinning the UK Internal Market Bill clauses - assets.publishing.service.gov.uk/government/upl…
"In the difficult and highly exceptional circumstances in which we find ourselves, it is important to remember the
fundamental principle of Parliamentary sovereignty."
"Parliament is sovereign as a matter of domestic law and can pass legislation which is in breach of the UK’s Treaty obligations. Parliament would not be acting
unconstitutionally in enacting such legislation."
"Parliament’s ability to pass provisions that would take precedence over the Withdrawal Agreement was expressly confirmed in section 38 of the European Union (Withdrawal
Agreement) Act 2020, with specific reference to the EU law concept of ‘direct effect’."
And the justification in law? " This principle was recently
approved unanimously by the Supreme Court in R (Miller) v Secretary of State for Exiting the European Union [2017] UKSC 5."

For those asking/concerned about PHE figures on covid-19 deaths and why the number yesterday was low/why the way it is reported has changed, here is some more information:
NHS has been providing figures to PHE on covid deaths by 9am every day and PHE then publishing stats at 2pm. That was the intention. But as deaths rise it has become difficult to collate and verify the numbers in time.
That has led to figures being published after the 2pm deadline. To get on top of this, PHE and NHS have decided to change the time these numbers are reported to allow more time to check they're all correct.

Interesting tactic increasingly being employed by politicians on a sticky wicket to blame “obsessive” media for asking questions they don’t like. Journalists are obsessive about answers, we will repeat Qs if we don’t get one the first time around.
So really the issue is with the actual question. This morning there are a lot of Qs on division in the Labour Party. That’s because of a failed plan to get rid of the deputy leader yesterday and the departure of a key aide overnight.
It would be a bit strange not to ask about those things given Andrew Fisher wrote the manifesto which sold Corbyn to lots of people at the last election, he is key to the policies.

NEW: Britain may be unable to prevent EU fishermen from entering UK waters illegally in the event of a no deal Brexit because there are not enough vessels to police the seas, an internal Government email has revealed.
It states: "There is a lot of uncertainty about the sufficiency of enforcement in a no deal because we have 12 vessels that need to monitor a space three times the size of the surface area of the UK."
The internal Defra email also warns: "This could have reputational damage for Defra and our ability to protect fisheries so we need to provide a strong line to rebut this."

People always seem surprised to hear Parliament really is close to falling down. Rain used to pour in through the windows in the Telegraph’s lobby office because they don’t close.
The basement floods on a regular basis (it’s also where all the wiring runs). There aren’t enough fire doors so firemen have to patrol the whole building turning off computers at night to reduce the risks.
A number of colleagues have got stuck in lifts, which despite the best efforts of staff regularly break down. The loos block on a daily basis and the water pressure often drops meaning they can’t be used for hours at a time.

Understand Number 10 now seriously considering indicative votes on Brexit next week. Government source tells me there could be 7 options: PM deal, revocation, second ref, deal + customs union, deal + customs + single market, FTA or no deal
Source says No10 in “panic mode”. Meaningful vote would still be held, but expectation is it will fail. Indicative votes would follow. Kwasi Kwarteng hinted this morning any such votes would be ‘free votes’ - not whipped.
A Downing St source referred me to David Lidington’s remarks in the Commons when I asked if No10 now backing indicative votes. Lidington has previously said MPs could be given more opportunities to express opinions on Brexit.
