I want to tone down my statements about this case.

Nobody ever knows for sure what a court will do. I've seen courts make some very bad rulings.

This case should get tossed out quickly, and I expect if this court goes off the rails, an appellate court will overturn.

1/
It should get tossed out because this form of voting has already been found to be legal by courts, and it is too late to bring this lawsuit.

Even Kavanaugh said that rules can't be changed too close to an election. Obviously they shouldn't be changed after people vote.

2/
This is particularly true if voters voted according to the rules that were in place at the time.

My takeaway from this is that Republicans are terrified by the way they know people are voting.

In the end, these tactics don't work.

3/
Agreed. Ultimately voters have the power.

The only thing right now that really scares me is the possibility that not enough voters will vote Democratic in this election.

4/
My secret worry: The Senate. The key Senate races are too close for comfort.

I'm reasonably sure Biden will win by enough margins that we'll get through the next few months.

In fact, the Senate numbers remind me of Trump/Clinton 2016

5/
This is the page I refresh constantly.
projects.fivethirtyeight.com/2020-election-…

Biden + a Republican Senate will stop the slide toward autocracy, but we will basically be treading water.

Biden + Democratic Senate means rapid changes (meaning a lot done in a year)

6/
With voter suppression, you have to get ahead of the curve (so to speak).

We went through this in California: Once you get enough Democrats elected, they can take steps to make it harder to cheat and suppress votes. Eventually, voter suppression ceases to be a problem.

7/
Texas has stunned me these past few weeks. I always figured Texas would turn blue AFTER the US Senate became Democratic (because the US Senate would make gerrymandering harder, etc).

But Texas is going faster than I expected.

8/
If you want to know what the future looks like in the US, my belief is that California tells the story.

Read this thread and notice the part about how the GOP, a shrinking majority, was able to gum up the works:

9/
If the GOP keeps the Senate, they'll be able to keep gumming up the works.

We'll all be frustrated.

I think we're in for an electoral map shift, with the mostly white rural states staying Republican.

Demographics are why Georgia, North Carolina, and Texas are going blue.

10
The states with demographics most like California will go blue faster.

Here's a roadmap for what it looks like when it happens:

11/
To quote two of my favorite scholars, Steven Levitsky and Daniel Ziblatt, ethnic majorities rarely give up their dominance without a fight.

That's why the Harris County shenanigans (to use a mild word) don't surprise me.

I expect them to fight against what is coming.

12/
There are whites who are afraid of diversity.

I have a distinct memory. I expect other liberals whites had a similar experience.

I remember when someone said to me, "If whites are not careful, they'll end up in the minority."

I was 17.

I thought: "So?"🤷‍♀️

13/
Actually, according to political psychologists, about 1/3 of people across cultures have a fear of diversity.

See, for example, @karen_stenner

Adding this here because I totally agree.

The fight is still on in Federal Court.

Slim chance that the US Supreme Court would allow a federal district court to overturn a question of Texas state voting law as determined by local TX officials including members of the state legislature, and the Texas Supreme Court.
Here's the thing: This federal district petition wasn't brought by the Texas GOP. It was brought by individuals.

In fact, local reporting says that the Texas GOP helped design the drive-through voting locations.

Here's what I figure . . .
Remember when Trump said that if we “get rid of ballots” there won’t be a transition of power?
nymag.com/intelligencer/…

Looks like a few Republicans took that to heart. But they're not stopping with absentee ballots.

They want to get rid of all ballots from Dem areas🤦‍♀️

Saved by the Nineteenth Amendment.

And the Fourteenth, and the Fifteenth.

. . . Ok, OKAAY. Saved by the AMENDMENTS.

You can see why some people (I won't name names) are in love with the 1787 version of the Constitution.

It would have been a lot closer.

If it was only up to the men, Biden would still be ahead, but STILL.

Actually women are saving the day.
Reactionaries like the 2nd Amendment and the 10th Amendment.
They also like to distort the First.

Some of the most important phrases in the Constitution can be found in the Fourteenth Amendment.

They include:
Due process.
Equal protection of the laws.

Exactly. It's the Strongman Con.

What's the strongman con?
I wrote about it here: justsecurity.org/72609/dont-bel…
When you panic, you help with the con.

The con: "The GOP can steal this election, so it doesn't matter how you vote."

1/
When the wannabe strongmen act like they can steal the election, and everyone panics, this amplifies the con and gives it credence.
justsecurity.org/72609/dont-bel…

Even with people amplifying the lie, we've seen that it doesn't work.

Look at Wisconsin in April.

2/
In April, the GOP did everything they could to steal that election.

Turns out, people don't like it when they know someone in power is trying to silence their vote.

Wisconsin voters overcame all the obstacles and the Democrats won.

Something I've always noticed. True leaders (like Stacey Abrams, Kamala Harris, and others) try to tamp down panic.

If someone is trying to get you to panic, take a deep breath.

Even in an actual emergency, a cool head saves lives.
This doesn't mean "don't be concerned."

It doesn't mean "pay no attention to warning signals."

It doesn't mean, "Don't prepare for emergencies."

Keep in mind that panic-inducing tweets get more clicks and retweets. Some sources thrive on the number of clicks they get.
I already retweeted this ⤵️Putting it here because it is wise.

Bad actors want Tuesday to be chaotic.
Bad actors want democracy not to work.

If you see an actual problem, there are hotlines and resources.

Correct.

States have their own deadlines. Ballots received by the deadline but not counted until after Nov. 3 will be included in the totals.

Ballots that arrive after deadlines may be the subject of legal disputes-- if they would sway the election.

1/
For a fuller explanation, see my blog post here: terikanefield-blog.com/election-law-1…

And for an even fuller explanation, see the @just_security piece I wrote with @steve_vladeck.
justsecurity.org/73135/election…

If ballots are late because of deliberate sabotage, those obviously must be counted.
2/
Democrats as a rule have voted earlier than Republicans. So batches of late-arriving ballots are likely to have more or equal numbers of Republican ballots.

Did I mention that nobody should put a ballot in the mail at this point, even if your state has a long deadline?

Biden reportedly has 4,000 lawyers on standby in Florida.
thedailybeast.com/biden-has-4000…
This has already been brought to the attention of a judge.

I am confident every vote will be counted (OK, I'm biased. I'm also a volunteer lawyer for the election.)
Get everyone you know to vote.

And no mail, okay? Drop off those ballots or vote in personal.
This video is what is commonly known as evidence 😉
