Can a pensioner file a suit to claim pension in the place where she is residing post retirement or the case needs to be instituted where the organisation is located or functioning from ? #SupremeCourt to decide.
Justice Ashok Bhushan led bench to shortly deliver #verdict
Supreme Court allows the appeal
Husband of petitioner was working with Coal India Ltd and he was getting pension since superannuation in Bihar. It was stopped and recovery notice was issued from Kolkata and he was later posted in Jharkhand.
He filed petition in Patna High court which was dismissed on lack of jurisdiction. Pensioner died and the widow challenged the order in DB, which the HC also dismissed.
#SupremeCourt allows appeal and holds that the place where pensioner is residing and receiving pension, part of cause of action arise at that place, therefore that court has jurisdiction.

The Counsel submitted that the NCC's objections were to the fact that she was a transperson, but that he needed further instructions on the exact nature of their objections.
