NEW: The fight to preserve Trump administration records has begun. The day after the election, the National Archives asked the CIA for a report on Mike Pompeo’s personal email use as director, responding to a complaint we submitted.

U.S. laws, including the Federal Records Act & the Presidential Records Act, require federal agencies & the White House to preserve most records & make their destruction illegal.

We’re especially concerned because the administration’s history with preservation is rocky—so rocky that the @USNatArchives has previously warned Trump White House lawyers about the need to comply with record preservation laws.

Recently, records from Mike Pompeo’s tenure as head of the Central Intelligence Agency, which we obtained via litigation, showed he also frequently used a personal email account to conduct government work.

We sent a letter on Oct. 22 to NARA, CIA, and the State Department, urging them to move quickly to recover any records that may not have been preserved, as required by law, due to Pompeo’s use of personal email to conduct government business.

In response, NARA has asked the CIA to “provide confirmation that Director Pompeo has forwarded all Federal record emails from his personal account to his official account, or has otherwise provided the CIA with a copy of such emails” within 30 days.
