Thakkar has also sought interim bail in FIR registered with the BKC Cyber Police Station and a stay on further investigation in both the remaining FIRs registered at VP Road police station and Sitabuldi Police Station, Nagpur.
Hearing begins
Senior Adv Mahesh Jethmalani: This is one of the most unfortunate case
Jethmalani: this is not a question of HC. We filed a plea on Oct 19 and it was listed today. All are bailable offences. If this does not shock you then nothing will
CJI: We are immune to shocks
Rahul Chitnis for state of Maharashtra: we have no opposition to the bail application moved today. Our custodial interrogation is over
CJI: We are not entertaining this plea under Article 32
Jethmalani: please record the statement by Mr Chitnis
CJI: We find it very unusual that you have to request us to listen to you. HC can transfer cases and can grant bail
Jethmalani: there are three FIRs against which does not disclose any offence. I had moved the HC, but then I was arrested in one after another instances under different cases with same matter
SC: Why you did not mention this in the HC?
Jethmalani reads his additonal affidavit: all offences are bailable offences. On Oct 24 he was arrested in Rajkot. Thereafter he was taken to Nagpur and was produced in inhuman condition with neck tied with rope. He was paraded on road.
CJI: What makes you think we are approving of all this? Approach the HC and let us benefit from the observation of the HC
Jethmalani: I am in custody for three weeks
CJI: Mr Chitnis has made a statement and you will get relief. We will allow you to withdraw this. We will not entertain this under Article 32
