Rubin wants $500 for December, then the balance ($6000) by January. Tenant says he can’t swing that.
Agreement reached, balance to be spread over 10 months.
“You understand if you’re a dollar short or a day late, you can be evicted without hearing?”
Next matter, last in docket, recessing so duty counsel can talk with Rubin, who’s representing the LL in this matter, too.
Back. Resolved. Was another arrears case (N4). Duty counsel trying to unmute. Arrears 4500$+. Full rent on time every month, + an extra 350 a month until the arrears are paid.
Whitmore: “You understand if you’re a dollar short or a day late an eviction order can be filed against you?” Yes. “This clears the block. Have a good day.”
So there’s 1h and 15m of the Landord Tenant Board.
To be clear, the LTB is an unjust eviction factory at the best of times, without COVID. But now, with masses unemployed, in the midst of an ever worsening pandemic, and with technological barriers to accessing hearings, it is even worse.
And on top of all that, as Whitmore himself said, the LTB is carrying out a “Blitz”, trying to push through as many evictions as possible.
I found dark humour in some of the absurdities of the process, and maybe you did too, but the overriding emotions are shame, anger, and disgust.
We are being utterly failed — as ever, yet somehow worse — by every level of government, not by oversight or error, but because their interests more closely align with the landlords than with ours. *This is what they want*, whether they admit it or not.
The good news is organizing with your neighbours actually works. You can’t ignore an eviction, but you can fight it. Get in touch to find out how:

Call your legal clinic and ask them to represent you at the hearing.
Some legal clinics have refused to represent tenants who won’t sign dangerous repayment plans. This is not OK. If they refuse, ask for a letter confirming their denial of service.
At the hearing a tenant can tell their side of the story. The LTB has the power to deny the landlord’s eviction case or to give the tenant time to repay the rent owing.
You will be given a minimum of 11 days but tenants can ask for more time to repay.
