2/ HGSAC FBI, p 50 shows matrix of which Steele memos were provided to FBI by various sources. Report 112, at issue in Aven et al, was NOT provided to FBI by Steele directly. FBI got it from journalist David Corn (Mother Jones) on ~ Oct 26; then later from Ohr, McCain, REDACTED. 
3/ Horowitz footnote 259 stated that "Crossfire Hurricane team received Report 112 on or about
November 6, 2016, from a Mother Jones journalist through then FBI General Counsel James Baker" (consistent with FBI matrix). Ohr, McCain versions not until December.

4/ Steele testified under oath in Aven case that he had delivered report 112 to FBI in mid-Sept (paras 51), a claim disputed by Plaintiffs. Warby said that this was "only issue in dispute" about disclosures.
5/ on the one disputed issue of fact - whether Steele gave Report 112 to FBI in Sept - Warby found in favor of Steele.
6/ as support for his finding, Warby noted that Steele had provided other memos to FBI, was "enthusiastically briefing" journalists, met with State Dept on Oct 11, all demonstrating Steele's "enthusiasm" for providing US authorities information "of type included in Report 112".
6/ Warby dismissed the OIG footnote as "multiple hearsay evidence from unidentified sources" and preferred the evidence from Steele ("a witness") which he said was "supported to some extent by a contemporaneous document" - Kavalec notes on Oct meeting that did not touch directly.
8/ Warby decided that "on the balance of probabilities, the footnotes are mistaken", due either to erroneous record keeping by the FBI or a mistake in preparation of OIG report or "some other reason".
9/ we now KNOW that OIG footnote was fully supported and documented by FBI matrix document (recently released.) We also see that FBI meticulously documented provenance of various versions in real time. and that their contemporary records show 112 arriving to them from Corn.
10/ in itself, the new information ought to overturn the "balance of probabilities". But there's more.

11/ but the new FBI information lists multiple Steele memos which were provided to Mother Jones journalist David Corn (including Report 112) which the FBI did not then have in their possession.
12/ Steele had been cross-examined on David Corn's possession of reports and claimed not to have given them to Corn.

14/ Steele deposition on this topic continues. Hard to believe that Warby J. gave credence to this bilge while rejecting explicit information in OIG Report based on actual FBI records as "hearsay".
