HOW DANGEROUS ARE SEARCH WARRANTS FROM ARREST WARRANTS? (Thread)

Kung mang-aaresto ang mga awtoridad ng isang indibidwal, kailangan ng WARRANT OF ARREST. Hindi ito hinihingi lang basta sa korte.
Lahat ng kasong sinasampa ay dumadaan muna sa piskalya at inaalam niya kung may sapat na batayan/dahilan (probable cause) para sampahan ng kaso ang isang tao sa korte. Preliminary Investigation ang tawag sa prosesong ito.
Sa stage na ito, pinapatawag ng piskal ang inaakusahan para sumagot sa mga alegasyon. In short, may chance ang kinasuhan na i-explain ang sarili niya.
Saka lang mag-iissue ang korte ng warrant of arrest kung na-determine ng piskal na may probable cause ang kinaso batay sa naganap na preliminary investigation.
Kung maghahalughog naman ng isang lugar, SEARCH WARRANT (SW) ang kailangan. Pero di gaya ng warrant of arrest na dumadaan muna sa piskalya para idetermine ang probable cause, ang SW ay diretsong inaapply sa korte.
Sa mundo ng mga dapat, ang husgado ay mag poprobe through searching questions and answers sa applicant ng SW at sa mga witnesses nito. Dapat MAS MAHIGPIT ang requirement ng application ng SW kasi nga, hindi ito nasasala sa level ng piskalya
at diretsong hinihingi sa korte. Ibig sabihin, walang pagkakataon ang kabilang partido para magpaliwanag ng kanyang sarili, 'di gaya sa mga taong sinasampahan ng kasong kriminal na dadaan pa sa piskalya ang ikinaso at ipapatawag pa ang kabilang partido para magpaliwanag
ANG TANONG, GAANO PO BA KA RELIABLE AT CREDIBLE ANG MGA KORTE SA PAG-EEXAMINE NG APPLICANT NG SEARCH WARRANTS?
kadalasan ay mga "informant" di umano ang nagtitip sa mga pulis na may firearms ang explosives ang mga aktibista. Nakita at kinwestiyon ba ito ng mga judge? Hindi ba kaduda-duda ang naratibong parang sirang plaka na paulit ulit laban sa mga aktibista?
Ayokong sabihin na hindi alam ng ibang huwes ang ginagawa nila at naniniwala lang sila sa mga tsismis at mga informant na walang kredibilidad, pero kung ito ay polisiya mula sa "itaas"
Sana naman ay mahimasmasan na tayo na napakaraming buhay ng mga inosenteng tao ang nilalagay niyo sa panganib. Tama na ang modus na ito.

TW: Today we received news that Ina Nasino's daughter could not possibly make it. 3-month old Baby River is confined in the hospital for pneumonia since Sept. 24. She's black & blue now & seemingly just waiting for her detained mother to visit her. 1/4
Baby River is critical now at the Neonatal Intensive Care Unit at PGH. Ina gave birth on July 1 and was forced to be separated from her baby on August 13 when the court denied her request to be with her daughter for 12 months so she can breastfeed her.

First, our Consitution provides for safeguards against unreasonable search & seizure and it is enshrined in Art. 3, Sec 2 of the 1987 Phil Constitution:
"The right of the people to be secure in their persons, houses, papers and effects against unreasonable searches and seizures
