Since the violations and threats of violations are getting imminent by the day, let me give a know-how of our rights against unreasonable search and seizure and what a search warrant actually looks like. (Thread)

First, our Consitution provides for safeguards against unreasonable search & seizure and it is enshrined in Art. 3, Sec 2 of the 1987 Phil Constitution:
"The right of the people to be secure in their persons, houses, papers and effects against unreasonable searches and seizures

of whatever nature and for any purpose shall be inviolable, and no search warrant or warrant of arrest shall issue except upon probable cause to be determined personally by the judge after examination under oath or affirmation of the complainant and the witnesses he may produce

Matapos ko mapanood ang dokumentaryong Aswang, gusto kong ibahagi ang personal na karanasan sa mga aswang noong pinaslang si Kian Lloyd Delos Santos. (thread)

Isa sa mga highlight ng drug war ni Duterte ang kaso ni Kian. Bagong pasa ako noon bilang abugado. Matapos ang pamamaslang kay Kian agad kaming nagpunta sa bahay nila sa Caloocan. Hindi makausap ng maayos ang pamilya delos santos,pero nangako ako ng taos-pusong tulong.

Napakaraming pulis na nagkalat sa lamay ni Kian at isang beses pinapunta kami sa crime scene. Sinamahan ko si Tatay Saldy, ama ni Kian. Kinausap ako ng taga NBI, pinipilit na ipalabas sa amin ang mga witnesses sa insidente dahil iinterviewhin at ise-safekeep diumano nila.

Under art. 125 of Revised Penal Code, you can be detained max of 36 hrs w/o charges for capital offenses, but w/the ATL, it's 14-24 days. We can't entrust the enforcement of this law to trigger-happy authorities, especially under the current admin & his successors. Here's why:

Here's Rolly Panesa, an innocent man, a simple security guard working in a hospital in QC. On October 6, 2012, while on his way home with his wife and the latter's daughter and son-in-law, men in plainclothes forced them into 2 vehicles. They introduced themselves as policemen.

The abductors were insisting that Rolly is Benjamin Mendoza, a high ranking member of the CPP-NPA in Southern Tagalog and his wife is Ka Luisa. This certain Benjamin Mendoza has a bounty of 5.6 Million Pesos.

Ina was arrested together w/ two other activists Alma Moran and Ram Bautista in Bayan-Manila office, in the middle of the night WHILE THEY WERE SLEEPING. The police planted firearms and explosives in their rooms that caused their immediate arrest.

Ina is a member of urban poor organization Kadamay. She organizes residents of Smokey Mountain, Tondo. Like many organizations critical of the govt, Kadamay is also being red tagged as front org of the CPP-NPA. At the time of her arrest, she stayed in Bayan-Mla.
