Judge Baraitser advises that the ruling will be available after the hearing. Warns everyone not to record. She will not read it, only touch on some of the points.
First point: Political offence - she will go the Act and not the Treaty which bars extradition for political reasons

Mr Assange went beyond the activity of a journalist. He agreed to use Rainbow Tables to help crack a password. Claims that if Manning had been able to log in as another user, it would have been harder to trace the activity. (cont)

Judge Baraitser makes reference to the Official Secrets Act.

The defence claims Mr #Assange is protected by free speech laws. The problem w/ that argument is the they assume he has the right to decide to act in a way that may cause harm. We have heard examples of harm caused.
Judge Baraitser: #Assange published unredacted cables. Reads statement from @Guardian journalists who condemned this....

Concludes that what #Assange did would be a crime in the UK under Official Secrets Act.
Judge Baraitser challenges the claim that the Obama administration decided not to prosecute.

Addresses UC Global case. It would be inappropriate for this court to consider incomplete evidence. If surveillance at embassy it may have been as "a command post" for his activities
Baraitser: There is no evidence that #Assange's defence was hindered.

Suffering of #Assange's partner and children is "nothing out of the ordinary.

There is no reason to think jury will be made of defence contractors
Baraitser: There is no foundation to claims that the US wants to punish #Assange as much as possible. No foundation to claim that Manning gave evidence under duress

Has confidence he will have fair trial protected by 5th Amendment
Baraitser: #Assange will have protection under the First Amendment. I reject the claims regarding Article 7.

Assange would not be protected by Article 10 if he were being tried in the UK.

This court trusts that a US court would uphold Assange's constitutional rights.

Baraitser: Details conditions at ADX Florence. As Mr Kopelman said: "Suicide prevention measures do not prevent suicide". I am satisfied that #Assange would complete his suicide. I have decided to refuse extradition and DISCHARGE Mr Assange!
Prosecution will appeal. Assange will remain in custody until judge has considered the appeal. Edward Fitzgerald has asked for some time to speak with #Assange, who didn't know what the result will be. EF may apply for bail.

Awaiting Judge Baraitser, #Assange is talking with Gareth Peirce. Mark Summers is talking on the phone, looking non-plussed.
Baraitser has arrived. Fitzgerald: The decision is between continuing with remand or bail. We will make our detailed application on Wednesday. Mr #Assange is at great risk in Belmarsh & we have a strict bail package

Statement from journalist Patrick Cockburn, Middle-East correspondent & writer on wars in Iraq & Afghanistan since 1977. He & other journalists on the ground suspected but could not prove - until @WikiLeaks revelations - that many civilians were being killed.
Cockburn reported on the 'Collateral Murder' & the shooting of the wounded, inc the Reuters journalist Saeed Chmagh.
The US claimed @Wikileaks caused harm but efforts to find victims have failed. @Wikileaks made every effort to redact names. Unredacted cables published by others.

Court in session. This morning's witness is Maureen Baird, who worked in the Bureau of Prisons (BOP) & as a warden who is experienced w/ Special Administrative Measures.

MB #Assange is likely to be subjected to SAMs
MB: SAMs prisoners locked in their cells 23-24 hrs/ day. They have no contact at all w/ other prisoners. They were allowed to go into another "recreation" (empty) cell. They can make 1 30' or 2 X 15' calls to approved family members per month. All mail is screened. Takes months.

As we wait for Judge Baraitser to arrive, we see that lawyer Yancey Ellis is waiting to testify. His practice appears to be based in Alexandria Virginia.

We will hear from a representative from the press association. Fitzgerald says the defence has been unable to take instruction from Mr #Assange, so they want to hear Mr Ellis's testimony first

One of today's witnesses is Patrick Eller.

Summers: At 11.30 last night we received the prosecution's bundle for witnesses. Mr Eller hasn't had a chance to read it. There has been an exchange between Eller & Kromberg & a challenge to his evidence. Eller needs an hour to read it.
Baraitser grants 1 hour. She received 2 statements last night. Questions whether they can be admitted. Lewis will give an answer today.

Now speaking about what journalists can disclose. Nothing more than what is discussed in open court, acc to defence.

Today's witnesses are expected to be be Dr Blackwood & Dr Sondra Crosby. Judge arrives.
Dr Blackwood his seen #Assange at Belmarsh & found him moderately depressed but he believes there has been improvement & Belmarsh has been managing this.
