Tucker's analysis that publishers rather than lawmakers are the guardians of the First Amendment also may set some First Amendment lawyers' heads to spin. Publishers are protected by the First Amendment. It doesn't require them to publish a senator's words.
Imagine being @FoxNews and you score the first interview with the senator at the center of a national controversy after raising his fist in solidarity and sending a fundraising plea ahead of a riot... and all you do is ask him to bash Simon & Schuster.
To be clear, the entire idea of the First Amendment is that government can't dictate what publishers print.
