OK - now #insurrectionBlues case @SDNYLIVE of Jeffrey Sabol, charged and arrested in connection with the assault on the U.S. Capitol on January 6 - Inner City Press will live tweet - thread - for now, song: soundcloud.com/innercitypress…
Magistrate Judge Andrew Krause is presiding. On Jan 20, he ordered detained another #insurrectionBlues defendant, Patrick Edward McCaughey III, for "crushing" Metropolitan Police Department officer Daniel Hodges. Inner City Press story: innercitypress.com/sdny2capitolmc…
Sabol did not fill out a financial affidavit. Federal Defenders will represent him only for presentment, and says Sabol may not qualify, will retain his own counsel.
[Elsewhere in SDNY, Columbia U "dirty doctor" Hadden has been ordered to pay $100,000 in fees]
Judge: Mr. Sabol, if you are not a US citizen, you have the right to consular notification.
Sabol: I am a citizen of the US... I have a Bachelor's degree.
Judge: You are charged with obstruction of law enforcement in a civil disorder
Judge Krause: Preliminary hearing in 28 days, since the 30th day would be on a Sunday.
Federal Defender: I don't anticipate any immediate plea and DDC won't consent, so Rule 20 is not an issue.
AUSA: The government is seeking detention.
AUSA: This may have started as a legitimate expression of First Amendment rights, albeit one seeking to overturn a legitimate election. But it quickly turned into an assault on law enforcement and elected officials. We have video.
AUSA: Mr Sabol was dragging a police officer down the stairs by the archway. Another man was beating the officer, ironically, with an American flag. Against this all we have are the defendant's self serving statements. He said he was enraged
AUSA: Mr. Sabol booked a flight from Logan Airport in Boston to Zurich, Switzerland. They don't extradite. Also, he has a residence in Colorado. He has the means to run away. He can afford his own counsel - so he may pose a flight risk [!]
AUSA: I'm sorry to bring this up, but Mr. Sabol's suicide attempts can be seen as from guilty. It's the ultimate flight attempt.
Judge Krause: I have considered the video. Please read the URL.
AUSA: washingtonpost.com/nation/2021/01…
Defense lawyer: We offer a $200,000 bond. They have not charged assault. He works in oil and gas. He's a geo-physicist. He's lived in Colorado for 28 years, he's been with his current partner 8 1/2 years. The psychiatric center released him.
Federal Defender: His sister is in the military and lives in Georgia. He attended SUNY-Cortland. He is specialized in removing unexploded ordinances. He had a DWI, sure, but it was a while ago.
Judge: Are you done? Do you have anything about the plane ticket?
Federal Defender: There could be home confinement.
Judge: If that were sufficient, there would never be risk of flight.
Federal Defender: There are suretors, for moral suasion. He could easily have driven to Canada, and he did not. He could have been worse.
AUSA: I disagree that home confinement and GPS would be enough. The ticket to Zurich and the suicide attempt demonstrate the extreme lengths he'd go to to escape these charges.
AUSA: If you are inclined to grant bail, we'll ask for a stay to appeal to DDC. If you don't grant a stay, we'll ask for a stay away from DC order.
Judge Krause: No need for ancillary arguments. Anyone can appeal, my role is to make an initial determination.
Judge Krause: This is not a presumption case. But the government has met its burden, and Mr. Sabol will be detained.
Judge Krause: The video is disturbing. What we see if Mr. Sabol dragging a law enforcement officer down the steps of the Capitol, where the officer is assaulted. He says he was in a fit of rage. This is beyond the pale. This is shocking.
Judge Krause: I am struck that a person with a stable job would engage in this conduct. He has many things going for him in life, his financial means - none of that stopped him from this conduct. Whatever prompted him on Jan 6, still exists in our world
Judge Krause: The attempt to fly to Switzerland is significant, and undercut his claim of strong family ties supporting release. Mr. Sabol will be remanded to the custody of the AG; I order him removed to DDC. That won't happen immediately.
AUSA: In weeks...
Judge Krause: I'll see an initial appearance before Magistrate Judge in DDC... The government will be in touch, once counsel is retained. Make that your top priority, Mr. Sabol. That's all. Adjourned

Judge Harvey: Sir, I'm sure you were told in the jurisdiction of arrest - and where was that?
Pepe: Southern District of New York. My attorney John Pierce is working to get me local counsel. For today, I'll take the public defender.
AUSA: Up in the SDNY, he was allowed to travel only in SDNY and EDNY. We want that and GPS monitoring continued.
Judge Harvey: GPS in the community?
AUSA: And I'm not aware of any curfew.

Gordon (not Gordan, mea culpa) - I would like the court to appoint an attorney for me.
Judge Harvey: Are you paid $75,000 a year?
Gordon: No.
Judge: How much in the bank?
Gordon: Nothing, as of today.
Judge: Ms Peters is appointed.
AUSA: We ask that he stay away from DC, except for court.
Pre-trial: Possess no firearms.
Defense: AUSA conditions are appropriate, not pre-trial's.
Judge Harvey: By Tuesday, verify your address. In Colorado, was it?
Gordon: No, Louisiana.
Judge: You told me that.

Williams was arrested in Florida. He has paid / retained counsel in DC.
Judge G. Michael Harvey: If at some point you can no longer afford counsel you can apply for one...
AUSA: An information has been filed in this case.
Judge: Let's arraign him.
AUSA: We are asking that he surrender passport and remove all firearms from his residence.
Judge Harvey: Pre-trial, anything?
Pre-trial service: No narcotics, courtesy supervision in Middle District of Florida.
Judge: Stay away from DC. Verify his address.

McBean: Did I ever go to a doctor?
Judge: No, is your mind clear today, for this proceeding?
McBean: Yes.

McBean: Yes, I'll make this video.
Judge Failla: If you plead guilty, and I accept your plea, there will be no appeal of whether you committed the offense. Do you understand?
McBean / Jeezy Mula: Yes, Your Honor.
Judge Failla: The maximum term of imprisonment is thirty years in prison.
OK - more serious #insurrectionBlues conditions requested for Hunter Allen Ehmke - "no firearms at all, & GPS monitoring," which other Jan 6 defendants today in DDC have not gotten. Inner City Press will live tweet from here, thread. Song: soundcloud.com/innercitypress…
Pre-Trial: With GPS he'll have to get approval to leave the Central District of California, not just the state.
Judge Harvey: Any problem with getting courtesy supervision?
Pre-Trial: No. What about any passport?
Ehmke: My passport was seized, by FBI I believe.
Ehmke's lawyer: We don't believe electronic monitoring is needed. He's charged with a felony, but only because of the dollar value of the window. So we want the standard conditions.
AUSA: We vehemently disagree. There's video of him kicking out a Capitol window
OK - another #insurrectionBlues case, rare female defendant Jenny Louise Cudd, third in a row before DDC Magistrate Judge G. Michael Harvey. Inner City Press will live tweet - thread below - song incl Judge Harvey here: soundcloud.com/innercitypress…
US says on Jan 6 "Jenny Louise Cudd, also known as Jenny Haning Cudd on social media platforms, & Eliel Rosa entered the US Capitol without authorization... Afterwards, Jenny Louise Cudd streamed a live video, via Facebook, which is a social

Cudd: Half way through my Masters program.
Eliel Rosa, also on the line, is 53. He is getting a free lawyer -
Cudd has her own retained counsel. Here is a photo from the US affidavit
