In the past months I got a lot reactions about the permit process according #GigaBerlin. I will shed a bit light on that komplex topic. What is the Bundesimissionsschutzgesetz (Federal Immission Control Act) and what is the status quo of preliminary approvals? A thread:

At first a little history lesson.
The BImSchG went out of the business regulations law from 1883 and was established in 1974. The US clean air act served as a model. Back than industrial emissions were recognized as a serious problem for the environment and human health.

Target is to protect people, animals and plants, the soil, water, the atmosphere as well as cultural and other material assets from harmful effects on the environment. That provides the law with 8 parts and in total 73 paragraphs. §8a is importand for #Tesla #GigaBerlin.

§8a - preliminary approvals

With these permits, #Tesla is able to build the factory very quickly at its own risk before a final permission is issued.

The approval process is regulated under §10 and includes the discussion meeting we had end of September. Its an importand step to hear concerns from different perspectives and to bring objectivity into the discussion. The results are evaluated and implemented into the process.5/x
Status quo of the approval process.

In the past months we saw 9 applications for preliminary approvals for different steps by #Tesla. The last one (Nr. 9) was approved at the 23rd December 2020. Now we are waiting for Nr. 8 and the final approval. 6/x

Number 8 includes:

Installation of the technical building equipment (power lines, sprinkler system, lighting, etc.), further machine parts and aggregates of the paint shop as well as machines and aggregates for the press shop and the body shop. 7/x
Why does it all takes so "long" (fast for german standards)?

I only can speculate on that. As you can imagine there are several possibilities to bring approvals to court. Every step must be legally sound. In addition, a record of the discussion meeting was necessary. 8/x
It took a very long time to create this and to incorporate the concerns into the process.
For the approval a lot of authorities are involved. For the 7. approval I count 12 authorities with partly own departments in the first "round". 9/x
#Tesla then modified the application during the editing process. More authorities and departmens had to be involved.
So it seems Teslas agility and flexibility is challanging too.

The future.

Tesla and the authorities will learn a lot and several discussions started already in Germany. For example adjusting the Verbandklagerecht (Right of associations to sue). As #GigaBerlin gets bigger we will see further applications.

1. Progress of #GigaBerlin construction

The drive unit is completly closed. Inside works begun a few weeks ago. This building acts as a template.
Paint roof is ready, BIW, GA, ST almost done. Roofing CA begins.
Machines get loaded into the painting since end of Ocotober.

2. Waiting for next permission

The permission will include among other things tree clearing and machine integration. The reason for waiting is that the descission needs to be legally incontestable. Therefore a verbatim record needs to be analysed.
