STATEMENT: Biloela family Federal Court decision.
Today, the full Federal Court handed down its decision involving the Tamil family from Biloela.

In an emailed decision sent to all parties on Tuesday morning, the Federal Court has upheld Justice Moshinsky’s April 2020 decision.
Lawyers for the family will now determine whether to appeal and call upon the Australian Government to immediately release this family from detention while legal matters are ongoing.
Lawyers for the family are currently assessing whether an injunction or stay of orders will be required to protect the family from further deportation efforts.
(Justice Moshinsky had ruled in April 2020 that Tharnicaa was not given procedural fairness when then Immigration Minister David Coleman considered lifting a bar preventing her from applying for an Australian visa.)
STATEMENT FROM CARINA FORD:
“We will be reviewing the decision and considering appealing to the High Court, and unless the Minister provides an undertaking not to remove, we will apply for an injunction. We also think this justifies the release of the family from detention. 1/
“There are several Ministers who have always had the discretion within the immigration portfolio to release this family into the community while their legal matters are resolved. That was the case in 2018, 2019 and 2020. It remains the case now, too. 2/
“The family should be released immediately from detention and we hope that this will occur.“ 3/3
STATEMENT FROM PRIYA & NADES:
“Thank you to everyone in Australia for the support and love that they have shown us. We are very grateful. It helps us stay strong. We just want to go back to Biloela. We need our little girls to be safe. Every day, they ask when can we go home?”

“We are deeply concerned about the ongoing wellbeing of our friends Priya, Nades and their beautiful girls. Today’s outcome demonstrates that the Australian Government will do all they can to keep this family in the courts unnecessarily. 1/3
“It has been nearly three years since our friends were taken from their home, from a loving community, and from safety. Since then, there have been dozens of days in court and over a thousand days without freedom. 2/3
“All of this suffering could have been avoided if the Prime Minister and his colleagues had shown some compassion. On the 1078th day of our friends’ imprisonment, we call on Mr Morrison to do just that.” 3/3 #HomeToBilo

The politicians isolated Priya, Nades and their QLD-born girls on Christmas Island, 5,000km from their Biloela home. They are now facing their second Christmas in detention. From today until Xmas Eve, can you join us in taking one simple action each day for Priya, Nades & girls?
