If Cuomo names the person who conducts the investigation, it’s not an independent investigation. It’s Cuomo investigating himself.
Update: Cuomo has dropped the plan of picking his own investigator. Asked NY's Attorney General and Chief Judge to select someone. Seems like a better approach.
I will note that one of the two people involved here, the Chief Judge of the Court of Appeals, is appointed by Cuomo. The AG is elected.
The New York Attorney General, Tish James, rejects Cuomo's proposal. She says he should make a referral to her office, which would give her the authority to conduct an independent investigation. Seems straightforward.
Cuomo now out with his third proposal. Asks Tish James to designate a private attorney to conduct the investigation. This isn’t what James asked for but it’s closer.
And a new apology from Cuomo: "I now understand that my interactions may have been insensitive or too personal and that some of my comments, given my position, made others feel in ways I never intended."
