Supreme Court oral arguments on petitions vs Anti-Terrorism Act resume, now on Day 4.

7 more justices expected to interpellate petitioners.
Former Supreme Court spox Ted Te appears on behalf of FLAG. It was Dean Chel Diokno who appeared in the previous 3 sessions of the SC oral arguments on ATA.
Retired SC Associate Justice Francis Jardeleza, amicus curiae, also present.
Justice Amy Lazaro-Javier continues her interpellation, this time, asking UP Law Prof. John Molo if a court can review factual basis of detention authorized by the Anti-Terrorism Council.
Lazaro-Javier raises executive privilege, asking how security of country and people affected if state secrets affecting national security are disclosed.

Molo says there's need to balance interests of individuals and State especially if penalty is life imprisonment.
Molo: In fighting a fire like terrorism, we do not throw the baby out with the bath water. We preserve the constitutional order by being different from terrorists. If we don't, we end up making them win, we are no different from the lawless elements we are fighting.
Molo says he will never favor terrorism, saying his father was a soldier and his grandfather was a police officer.
On the powers of the Anti-Terrorism Council, Lazaro-Javier points to its composition and some safeguards under the law, including requirement to inform nearest court and Commission on Human Rights.
In discussion on wiretapping, Lazaro-Javier says it will only be allowed if authorized by the Court of Appeals, which she says, is composed of justices of proven competence, probity, integrity and independence. Shouldn't ATC members be entitled to same presumption?

JUST IN: Only 3 SC justices in the running for chief justice post: Senior Associate Justice Estela Perlas-Bernabe, Associate Justice Alexander Gesmundo and AJ Ramon Paul Hernando, accdg to SCPIO and Sec Menardo Guevarra. Only the 3 submitted complete documentary reqts.
Guevarra on CJ race: No other persons applied (apart from 3 SC justices).

No documents were received from Justices Leonen and Caguioa. I couldn’t speculate on the reason. Either not really interested or unable to complete and submit all the requirements on time.

Judicial and Bar Council extends deadline for submission of documentary reqts for applicants/nominees for chief justice to Feb 25, JBC member Justice Sec Menardo Guevarra confirms. SC source says all 5 most senior magistrates accepted their automatic nominations.
Among the 5 most senior SC magistrates, Senior Associate Justice Estela Perlas-Bernabe and Justices Marvic Leonen and Alfredo Benjamin Caguioa were appointed by PNoy while Justices Alexander Gesmundo and Ramon Paul Hernando are Duterte appointees.
Guevarra also confirms SC resolution expressing its sentiment to exempt 5 most senior SC magistrates from undergoing public interviews and submitting documentary reqts already with the Court. Says JBC to include it in its agenda on Thursday.

BAR EXAMS UPDATE: Supreme Court approves “digitalized, localized, and proctored” Bar Exams to be held all 4 Sundays of November 2021. SC to identify local testing sites. Guidelines for taking Bar Exams to be announced by May. SC to start accepting applications by then.
SC will require Bar examinees to bring own Wi-Fi-enabled laptops with the reqts below. Desktops, tablets, smartphones not allowed. Laptops must not have any files related to the Bar Exams. Exam will be proctored in a testing room with surveillance cameras.
During Bar Exams, SC personnel will check hardware and ask examinees to sign honor code. Examiners will grade Bar Exams digitally. Handwritten exams allowed if examinee has physical disability. Hygiene protocols to be observed.
