HC says the obligation of the State to provide sufficient infrastructure to save lives of people can't be understated and even the most economically advanced nation have found their infrastructure to be lacking to deal with a massive surge of cases
"The existing medical infrastructure in the State is being completely exposed when it is put to test. This court cannot turn away the petitioner by merely telling him that the state doesn't have the infrastructure, " HC says
HC says at the same time, there are thousands of others who are infected & have an equal claim but these people may not have the resources to approach Court. HC says it shall be the obligation of the State to provide bed with ventilator facility.
"Merely because we have passed this order, it does not give any preferential right to the petitioner," the Delhi High Court says.
