This is a majority opinion by Judge Brasher limiting application of the First Step Act. The 11th Circuit ruling conflicts with every other appellate ruling — including ones from the 2nd, 4th, 5th, 6th, 7th, 9th, 10th circuits, per Berman.
Brasher is a 39-year-old former Alabama SG who was nominated to the 11th Circuit by Trump six months after he started work as a district court judge.
He was joined in the majority opinion by Judge Luck, a 42-year-old Trump appointee.
The dissent was from Judge Martin, a 65-year-old Obama appointee who was one of his first five appellate court nominees in 2009.
For non-lawyers, two Trump appointees to a southern appeals court just made it harder for people in Florida, Georgia, and Alabama to receive the full benefit of the First Step Act — a law that Trump claimed as his key criminal justice reform.

Scott is most effective, rhetorically, on policing, race-based discrimination, & voting — using his own experiences w/ racism to try to push back against Dem attacks on GOP policies/positions. It was an attempt to connect, but then he just went off into defensive talking points.
