Former Advocate General Vijay Narayan is appearing for @actorvijay before the Madras High Court to argue appeal in Rolls-Royce Ghost car case @THChennai
He says Mr. Vijay is ready to pay the tax. He only wants expunging of "unjust" remarks made by single judge and to set aside costs of Rs.1 lakh
Mr. Narayan refers to "simple and plain" dismissal orders passed in similar cases filed by others challenging entry tax. Says single judge has made "uncharitable" remarks against actors community at large in the case filed by Vijay alone.
Mr. Narayan says profession of petitioner is of no relevance at all. Therefore, judge need not have taken exception to non mentioning of profession in the affidavit.
We don't require a judgement to say what is the purpose of taxation, says the senior counsel. By making strong observations against Mr. Vijay, judge has branded him as having anti national attitude and such remarks are unfair, he adds.
Keeping the writ petition pending for nine years was not because of the fault of Mr. Vijay, says the senior counsel
Mr. Narayan says people who have money are entitled to spend it the way they want & therefore the judge need not have commented about no use in travelling luxury cars and so on.
Mr. Narayan says every citizen is entitled to challenge imposition of tax.
Mr. Narayan says single judge had added insult to injury by imposing costs of Rs. 1 lakh
Mr. Narayan says if Tax Officer raises a challan, Vijay will pay tax within a week.
Mr. Narayan reads out a Supreme Court judgement against harsh and disparaging remarks made by courts against litigants.
Supreme court had insisted upon judicial restraint, Mr. Narayan says.
Supreme Court had said judges should avoid banters and unwarranted remarks, points out Mr. Narayan. After all in a batch of 500 cases, the judge cannot make scathing remarks in only in Vijay's case, he argues.
Remarks may be expunged and costs can be deleted, Mr. Narayan says. There's no justification at all in making these remarks. We were totally shocked by these remarks. Any human being will feel hurt especially because of adverse publicity, he adds.
Justices M Duraiswamy & R Hemalatha of Madras HC stay operation of a critical order passed by a single judge against @actorvijay in Rolls Royce Ghost case. Permit him to remit the entire tax amount in the meantime.
