Advocate Manish Dembla: the applicants are here fishermen. there was four heads of compesnable loss. no compensation has been paid to these two members. Kerala govt had recognised that out of 2 cr paid to boat owners these two have to be paid too

Dembla: Kerala govt has now said no compensation will be given to us on account of latest #supremcourt order. We just want the 2 cr compensation be stayed

Justice V Ramasubhramnium: You were employed with St Anthony boatman. but he is not a party here. its for him to oppose this

Adv: I am myself not a party we seek impleadment

SG Mehta: the boat owner has died in the accident perhaps. alternatively he can approach the Kerala hc for quashing and they can examine

Dembla: Kerala HC says unless there is an order in your favour from Supreme Court they cannot help me

Justice Ramasubhramnium: when did court say this? whatever court says should be in form of order

Adv: the boat owner did not die. Please direct kerala hc to hear me

Justice Indira Banerjee: the para 8 of the order is clear whom compensation is to be paid to. its to the heie of the deceased and 2 cr to boat owner. there is nothing about the crew of the boat.

Advocate Dembla: disbursement is still pending by the HC. the money has come to centre and not yet disbursed

Justice Banerjee: Now if we modify this, the amount for other beneficiary may go down

SC: We can issue notice to the boat owner and decide to modify the order.

SC: We issue notice to the boat owner. List after two weeks. In the meanwhile, we request the HC not to disburse any amount to the boat owner

We can perhaps direct Kerala HC to take a call with regard to this. But we cannot do this in absence of the boat owner: Justice Banerjee

Supreme Court does not modify the order. It remains as it is.
