I published this piece yesterday about the global push to stop #NDAs covering up sexual misconduct in the workplace. This reform is long-awaited and sorely needed. A thread (1/10) ibanet.org/NDAs-global-ca…
I first met the inimitable @ZeldaZeldaluna in 2018. It was a year since she broke her NDA to speak out about film producer Harvey Weinstein. I'd heard about her case, but only through interviewing her did I truly understand how damaging NDAs can be (2/10) ibanet.org/Conferences/30…
She's worked tirelessly to advocate for their reform in the UK and beyond. She introduced me recently to @ProfJulieMac who has an equally inspirational backstory. Barely any legal reform on NDAs has happened since #MeToo and #TimesUp@cbmsilence hopes to change that (3/10)
My latest article focused on Ireland's moves to reform NDAs in the workplace. The charge is being led there by Senator Lynn Ruane. I was fortunate enough to speak to her and @ProfJulieMac and @GeorginaCLee who helped draft the proposed legislation (4/10)
Through them I learnt about the latest developments in Canada by @LundLynne and @SenMarilou. As I drafted my piece I saw that California had passed the Silenced No More Act thanks to @SenatorLeyva and @IfeomaOzoma Global momentum is building (5/10)
It also highlights the inertia on NDA reform in the UK. @MariaMillerUK and others like @jessphillips through their work on @Commonswomequ have been pushing for progress. The government hasn't spoken publicly on this issue since March 2019 ibanet.org/article/096791… (6/10)
Baroness Helena Kennedy QC, Director of @IBAHRI told @Commonswomequ in January 2019 that NDAs should never be used to cover up discrimination, sexual assault, sexual harassment or bullying. She maintains they should 'never inhibit justice in criminal matters.' (7/10)
Yesterday @MariaMillerUK introduced a 10-Min Rule Bill on NDAs in Parliament. She told MPs that the UK 'cannot be left behind'. To hear Maria & @ZeldaZeldaluna speaking more on this subject, listen to my podcast from 2019 on 'The dark side of NDAs' ibanet.org/Podcasts/73356… (8/10)
For my background on all of this read my feature from 2019 on gagging orders and the role of lawyers and regulators in perpetuating a culture of sexual harassment ibanet.org/article/7D8057… (9/10)
I shouldn't still be writing about the misuse of NDAs, but at least it feels like change is finally happening. @ZeldaZeldaluna told me recently that she was always worried that the conversation would stop. It hasn't. Global reform is upon us (10/10)
