His lawyers' motions for release detail what Lang saw outside the west terrace tunnel when Roseanne Boyland died. "What about men who showed up to peacefully protest...

physically beating women, do you just turn a blind eye and back on unarmed, defenseless women. These helpless, unarmed women being physically beaten right in front of these men lends justification to these men’s actions." Several of those men are in jail under pretrial detention.
"Lang witnessed women with their back turn to police being physically assault by police. He witnessed women being trapped with officers, who repeatedly beat these women with batons over the head. Not everyone intended to act the way the government has portrayed them."

Lang's lawyer Tankleff: Detailing Lang's conditions in jail. Lang has been in "the hole" repeatedly. Attorney visits are exposed, everyone can hear the discussions. In-person client-attorney meeting would force Lang back to 14-day quarantine

Judge is Carl Nichols, a Trump appointee.

Tankleff wants Lang released so they can prepare his defense. Current 6A violation.

Nichols argues if he releases Lang, he'd have to release everyone in DC jail. Defense attorneys repeatedly claim they cannot access clients in DC jail.
Lang attorney Metcalf: Submitted a video as exhibit. "Shows a story there was more to this situation that what's been portrayed in the media."

Video at 3:05pm - an elderly woman is being beaten with batons by multiple officers. One officer beating her, one officer spraying her.
Lang went there to record on social media what happened in the protest. 1A rights.

Met with officers with tear gas, flashbangs, and orange gas that made people "almost pass out instantly."

People had to take action. Numerous instances of excessive force. "A woman died."
People were being hurt and dying. Officers would not stop. Lang picked up at least one man who was injured. Did what he could "to save other people."

Judge reads text messages Lang sent talking about "war" after the protest. Also asks about Lang swinging bat toward officers
Judge and Metcalf debating timeline and Lang's use of riot shield, bat. Says officers were attacking protesters who were trapped in the tunnel.

"People were getting sprayed in the face with gas, being hit on the head with batons."

Even DOJ has admitted this in filings.
Prosecutor says government cannot directly identify attacker with officer attacked. They've said this in other hearings, even arguing they do not have to name the officer cited in a criminal complaint against someone charged with assaulting a police officer. Cute trick

The "rioter who passed away" at 4:26pm - Lang tries to get officers' attention to help her.

She passed away from a "drug overdose" prosecutor says. Also DC coroner conclusion. Others are doubtful.
Judge asks, what is risk of letting Lang out? Defendant poses a risk bc he advocates violence to advance his political beliefs and he attacked law enforcement.

Prosecutor: He wanted to "stop President Biden from taking office." He wanted to interrupt the inauguration.
Judge: Conditions in DC jail make it difficult for defendants to prepare its own defense.

DOJ: It's a "structural problem" in the jail. But phone communication is available. It's Lang's choice not to be vaccinated and forced into quarantine for 14 days if he meets with lawyer.
Lang speaking. What happened in that tunnel was “brutal.” Says DOJ hiding video that shows police brutality.

Lang explained DC detainees were punished Saturday bc of protest. Locked in basement.

Says he’ll abide by any release conditions so he can mount his own defense.
Judge taking a brief recess to figure out whether he'll issue a ruling today or take it under advisement.

No chance he releases Lang IMO.
Judge Nichols is back. Notes Lang is charged with violent crimes including assaulting police.

Nichols: Lang views the current US government as illegitimate because he protested the election. He is entitled to presumption of innocence. LOL he's been in jail for 8 months
Judge will not release Lang. Claims he's still a threat based on text messages he sent after January 6 and said threatening things about inauguration.

Motion to release DENIED.
Remember, kids, all these DC judges ruling that anyone charged (not convicted) of assaulting federal officers must be in jail awaiting trial bc they are dangerous. Also if you don't accept election results, you are a danger. I am SURE this will apply to everyone in the future

A little late to this hearing. Lawyer for Cuoy Griffin blasting DOJ for refusal to turn over Brady 7 months later. Finally fighting DOJ nonstop request to exclude time from Speedy Trial clock. DOJ forcing defendants to choose btw speedy trial or receipt of exculpatory evidence.
Complaining DOJ will not release videos showing police moving barricades and letting people into the building. DOJ has the videos, won’t allow defendants to access. This includes USCP surveillance video and open source. “Sophie’s Choice” of his rights.
Of course McFadden defending DOJ. Lawyer has OPR reports on USCP that shows officers letting people in. Prosecutor claims they’re working on it. Griffin not charged with serious crime. Prosecutor accuses Griffin lawyer of misrepresenting facts.

Now maybe @alanfeuer knows something I don’t. Please disclose how many protesters who’ve disrupted Congress were held behind bars for MONTHS on an obstruction charge. Especially under a statute aimed at interfering in Congressional investigations not a political protest.
Now @alanfeuer won’t engage me because that propaganda is aimed at gratifying the bloodlust of NYT readers. It’s not up for serious debate. Maybe Alan can explain how it’s ok to keep nonviolent defendants such as Watkins, Meggs, Harrelson, Hale at DC jail for several months?

Jessica Watkins was arrested and charged in January for nonviolent role in Capitol breach probe.

Her congressman?

Jim Jordan.
Kelly Meggs arrested in February. He’s been detained ever since.

Ken Harrelson arrested in March. He’s been detained ever since. His lawyer today said he looks terrible, can’t get a shave or haircut, has a medical condition.

Oath Keepers status hearing. DOJ says it’s making “progress” on discovery. Lol FBI put together still shots of USCP surveillance video for defense. DOJ does NOT want that video made public or even to defense. Just amazing.
Reminder that DOJ and USCP have total control over 14,000 surveillance video from January 6. In a recent update, DOJ said half the footage was not relevant to J6 investigation.
Judge Mehta asking if defense will be able to access video for a specific area of the Capitol.

He says it’s “critical” for defense to access video. The legal battle for USCP footage will be huge.

As we mourn the murder of nearly 3,000 Americans while taking our lives back to that horrific and heartbreaking day 20 years ago, I wonder how many feel how I do.

Look no further than the collaboration between every powerful interest in 2020 to oust Donald Trump. When the folks in charge hijack one of our most sacred rights, then brag about it in plain sight, what’s more threatening to our democracy than that?

Big hearing today in Oath Keepers case. Two motions on the schedule - change of venue and motion to dismiss obstruction of official proceeding count.

First trial date is set for end of January for detained defendants. Five Oath Keepers are behind bars awaiting trial, some have been in jail since January. Accused of no violent crimes.

Mehta addressing Ken Harrelson -- John Pierce was his attorney. He's been MIA.
David Fischer is Thomas Caldwell's attorney. He has filed a lengthy motion that argues obstruction of an official proceeding did not apply to Electoral College certification. Other attorneys have as well.

There is zero change Mehta will dismiss this charge.
