Judge Amy B. Jackson presses back on that. Points out that Sibick grabbed Fanone's badge and radio in different hands, not in the same motion.

Sibick's attorney is claiming Sibick was trying to help Fanone when he reached for him.

His attorney is saying now Sibick tried to use Fanone's radio to call for help for him. DOJ says Sibick didn't press radio button until 17 minutes later.

Judge Jackson asks if there isn't a picture of Sibick holding a police riot shield too.

"Yes, the shield that tried to kill him," his attorney says.

So he took the time to take a picture with it, Jackson asks?

"Yes, and that's not a good look," attorney says.
Judge Jackson: "I fully respect his decision to come to a rally and see the president speak... but we're not talking about that." Seems decidedly unconvinced by Sibick's arguments that these were "just 2 seconds." He was in middle of riot while people were attacking police.
Sibick's attorney incorrectly states that "nobody is being held because they tried to break into the Capitol." That's not true. The destruction of property charge is precisely why Proud Boy Dominic Pezzola is being held. wusa9.com/article/news/n…
Sibick's attorney, Stephen Brennwald, also incorrectly claims #CapitolRiot defendants are only being held if they're accused of crimes of violence. Wrong again. A number of Proud Boy and Oath Keeper defendants are being held on conspiracy/obstruction charges w/o violent charges.
Brennwald claims Sibick has "asked to be put in the hole," where he has been for two weeks, because other inmates were giving him a hard time for listening to guards in jail.
DOJ says the evidence shows Sibick's "whole-hearted participation in a violent mob." Also says Sibick only admitted he had Fanone's badge "when he faced the possibility of his lies being uncovered." Sibick buried the badge in his backyard.
Judge Jackson is taking a minute to decide whether she's going to rule from the bench today or not.
Judge Jackson is back. She finds that the video shown in court today was not known to Sibick at the time of his detention hearing, but also that it's not material.
Judge Jackson: "He took his own unique, independent, purposeful action. The video clearly shows moving his left hand in and then his right hand in. Not at the same time, moving in with both hands to pull up."
Jackson: There's nothing in the video showing Sibick trying to help Fanone: "He may be a helpful person in life, but he was not helping on January 6."
Judge Jackson says there's nothing in the video that shows Sibick was shocked to grab the badge and radio. Says he doesn't drop them, or go find another officer for help, "even though he has time to pose with a shield."
Judge Jackson has denied Thomas Sibick's motion to reopen his bond detention hearing: "I just do not accept the representation that that video changes anything or shows anything different."
Judge Jackson tells Sibick's attorney he can file a new motion asking her to reconsider the "whole situation" of Sibick's detention under 18 U.S. Code § 3142(g) if he's so inclined.

We have a status hearing starting now for former Special Forces soldier Jeffrey McKellop. He's on the line, irate, with his attorney. wusa9.com/article/news/n…
The DOJ says a plea offer remains pending in the case, but they have not had further conversations with McKellop's attorney about that. DOJ is asking for another status hearing in 30 days.
McKellop has asked Judge Carl Nichols to reconsider his detention status. DOJ says they oppose that, and also that he can't meet the conditions required to reopen a detention hearing anyway.
