Exposing the sketchy doctor James Spar who denied Britney’s right to hire her own lawyer - a #FreeBritney thread
Dr. James Edward Spar is a geriatrics doctor, meaning he specializes in care for older people, and he has deep ties to UCLA where he is a professor and director at the School of Medicine. #FreeBritney
Importantly, James Spar helped pass the California probate laws in the 1980s that established the how to determine if someone has the capacity to make their own decisions, or not. He also created many of the forms, like the “Medical Consent Capacity Declaration” #FreeBritney
Doctor Spar was recently featured in the Netflix documentary #BritneyVsSpears where he first admits to meeting Britney, but then refuses to acknowledge that he ever evaluated her. #FreeBritney
On February 1st, 2008, Britney Spears was put under a court-ordered conservatorship by her father Jamie. In the original paperwork, they checked a box saying this was related to “dementia placement or treatment” which is odd because Britney was only 26 at the time. #FreeBritney
In the days following the implementation of the conservatorship, attorneys for Jamie Spears admit they spoke to her “treating physician” at the UCLA Medical Center named James Spar, M.D. #FreeBritney
Britney found out through her custody attorney the next day she was put under a conservatorship, and she immediately hired Adam Streisand to represent her. He sent Jamie’s lawyer an email saying this was “a hostile takeover of our client for improper purposes.” #FreeBritney
That same day, Jamie’s lawyers contacted another Dr. Stephen Long, who had treated Britney in 2007, and asked him to submit the “capacity declaration” required for the conservatorship. Dr. Long refused to discuss this matter with them. #FreeBritney
On February 4th, Adam Streisand appeared in court on behalf of Britney, but the judge kicked him out of the courtroom citing a “medical report” that he wasn’t allowed to see. #FreeBritney
Now it gets weird: the minute order says Britney didn’t have the capacity to hire Adam based on a report from Dr. Spar, but then they seek out another doctor Steve Marmer to determine if she has the capacity to hire an attorney by February 13th? Very odd. #FreeBritney
Despite all of this, a capacity declaration has never been filed in Britney’s case because they claim the conservatorship is “voluntary.” Therefore, Britney’s capacity was never adjudicated. #FreeBritney
Here is Adam talking about Dr. Spar’s report in an interview on CNN #FreeBritney
Even though they clearly disagreed about Britney’s capacity, Adam Streisand and Dr. Spar have since worked together on various publications about mental disorders that erode capacity. #FreeBritney
Dr. Spar participated in a mandatory training program back in 2010 with the judge on Britney’s case Reva Goetz and her court-appointed attorney Sam Ingham. #FreeBritney
And Dr. Spar participated in a 2012 symposium with judge Goetz, Andrew Wallet’s business partner Lynard Hinojosa, and Bruce Ross who worked with Vivian Thoreen at Holland & Knight. All of these are players involved in Britney’s conservatorship. #FreeBritney
Beyond Britney’s case, Dr. Spar was involved in a lawsuit for minimizing a woman’s complaints about discrimination at UCLA. She was awarded a $2.95 million judgement. #FreeBritney
In 2014, Dr. Spar completed a capacity evaluation on Donald Sterling, who owned the Los Angeles Clippers. Despite his problems being “mild” and scoring 24/29 on the test, Dr. Spar determined he couldn’t manage his own affairs and he was no longer competent. #FreeBritney
Here is a voicemail that Donald Sterling left for Dr. Spar #FreeBritney
In 2016, Dr. Spar was paid to testify in the defense of Sheriff Lee Baca, saying he didn’t have capacity when he lied to FBI. Federal prosecutors objected, saying Dr. Spar’s conclusions were unfounded and amounted to “junk science.” #FreeBritney
The judge agreed, ruling that Dr. Spar’s testimony would be a “waste of time” and “would only serve to confuse the jury.” Sheriff Baca was later convicted. #FreeBritney
Finally, Dr. Spar worked with Britney’s former court-appointed attorney on the Summer Redstone case, who previously owned Viacom/CBS. #FreeBritney
Dr. Spar he doesn’t know why Britney is still in a conservatorship, but he has yet to confront the fact that his declaration was used as justification to deny Britney the right to an attorney of her own choice. #FreeBritney
In conclusion, Dr. Spar’s declarations of incapacity seem to be completely subjective and/or based on who is paying him to complete the evaluation. He must be investigated and held accountable for his actions. #FreeBritney
