1. A year later, has protection for any new British names been approved in Japan?

No.

The official Japanese list for foods still has only the original three UK names ⬇️

@tradegovuk even announced on Twitter that it would submit a list of 70 British names in January 2021.

It said protection would be completed within five months (in the previous tweet in the thread ⬇️).

A year later, here’s ⬇️ an update from @tradegovuk.

Talks started early in 2021. The UK list was submitted in April.

These British geographical indications “will now go through Japan’s procedures as quickly as possible”.

2. So whether or not new names have been registered, they surely will be, in due course. That’s not what was wrong.

3. What was wrong was the claim that this could only be done under the 🇬🇧 UK-Japan 🇯🇵 deal.

It was/is possible under 🇪🇺 EU-Japan 🇯🇵

In fact, while no new British names have been protected in Japan, since Feb 1, 2021 the EU has obtained protection in Japan for 28 new names

So the answer to @EvanHD’s question:

@GregHands and @tradegovuk were wrong to claim the UK-Japan CEPA “goes substantially further than the existing EU deal” on geographical indications.

The EU has added 28 new names.

The UK? None (so far).

P.S. Apparently there are 17 more EU names in the pipeline. This list was published in August, with comments open.

The reaction among trade experts to US Trade Representative Katherine Tai’s speech in Geneva on Oct 14 has been mixed.

Some welcomed the optimistic tone. Others were disappointed at the lack of specifics.

WTO members met again as the intellectual property council today, both formally and informally.

BOTTOM LINE:

One year after it was proposed, NO CHANGE IN POSITIONS on the proposal to waive some intellectual property protection for COVID-19,

FOR—suspending protection will allow countries to copy vaccines and other products

AGAINST—other solutions are effective, protection is needed as incentives for innovation, no evidence that a #TRIPSWaiver will help transfer technology

3/4. But the official answer to Q2 is:

The number of participants in the services regulation talks listed = 27

That's right. 27. Even though the EU is itself on the list, it's told the WTO that the count must be 27.

This is indeed important news.

Some additional points

1. These are talks among a subset of the @wto membership—a “plurilateral” involving 65 of the 164 members—a negotiation among the willing. It’s seen as a way of getting around the consensus rule.

A hot topic for both—#WTOreform.

Perversely, @BobWolfeSPS and I say forget “WTO reform”.

It puts the focus on Geneva, when the real problem is in and between capitals.
