Last time he was before Judge Amy B. Jackson, Sibick's attorney, Stephen Brennwald, argued he was trying to help Officer Mike Fanone up when he inadvertently robbed him of his badge and radio.
Jackson, needless to say, was not convinced.

Thomas Sibick's attorney says he was "one person before 2016, and one person afterward." Says he went out to Utah to "find himself" and then came back and started school, got his MBA by 2019.

"He was a changed person, decided he needed to settle down, buckle down."
"He was on track to finally grow up," Thomas Sibick's attorney says about his supposed change after 2016. He's responding to Judge Jackson saying she has grown more concerned about Sibick's previous criminal history.
"His mental thought process has changed a lot," Brennwald says. "I'm not saying he's a liberal. I'm not saying he's an Elizabeth Warren fan. But his mindset has changed so much that he had to get out of that unit."
Brennwald says #CapitolRiot defendants being detained together in the D.C. Jail are "radicalizing." Says he's heard them singing the Star Spangled Banner, which they do every night at 9. "It was almost cult-like." Referring to this story by @misstessowen. vice.com/en/article/akv…
Judge Jackson: "He came here fired up about the stolen election. Where was he getting his information? Facebook? The news?"
Brennwald says Thomas Sibick was "watching Fox News in a manic haze" and came to D.C. on January 6.

Brennwald suggests a release condition could be that Thomas Sibick not be allowed "to watch TV or anything that could inflame his thoughts."
Thomas Sibick's father, Dr. Eugene Sibick, is going to speak now. Judge Jackson is warning him that, if she releases his son to his custody, he has to be the one to alert pretrial services and send him back to jail if he violates the terms of his conditions.
"I'm not going to order that he not watch Fox News. I'm going to order that you turn off the talk shows, period. No MSNBC either," Judge Jackson says. "I'm trying to make sure it's a calm environment. And I'm looking to you to make sure of that."
Thomas Sibick's father breaks into tears, saying he'll do anything he has to to get his son home.
Brennwald: "I want to add that Mr. Sibick has gone through extraordinary lengths to separate himself from the toxic environment he was in in that unit."
Judge Jackson is granting the motion to reopen the detention hearing. Has not ruled on whether to release him yet (although it sounds like she's leaning that way).
Judge Jackson: "It's true that he comes from a good family, a good upbringing, but that comes both ways. Because it means at all points, including on January 6, he knew better!"
Judge Jackson: "It's worth noting that, despite what people say about CTF, he experienced this [mental health] breakthrough with the help of the professionals there."
Judge Jackson says the government has "scoured" Thomas Sibick's social media, and it shows he did not make the kind of threats, before or after January 6, that have resulted in other #CapitolRiot defendants being held pretrial.
Judge Jackson says she's compelled by the "toxic environment" and the "incredible pressure [Thomas Sibick]'s had to resist to be someone" in the D.C. Jail unit where the #CapitolRiot defendants are being held.
Judge Jackson: "I'm giving you the benefit of the doubt, which I think you've earned... please understand, Mr. Sibick, that you will get only one chance."
Judge Jackson releases Thomas Sibick to the custody of his parents. He will be under 24-hour home incarceration, must stay away from D.C. and any political rallies and must continue his psychiatric treatment. No firearms. Can't watch any political TV programming. No social media.

DOJ says it is "not cooperation to provide false information, misleading information and half-truths, and that is what happened in this case, particularly with Lori Vinson." Also points to her "clearly doubling down statements" about January 6 to the media.
In an interview, Lori Vinson said she felt what she did on January 6 was "justified" and that she would "do it again tomorrow."

Before people jump the gun on this... Smocks is only the second felony defendant sentenced in the case and he has a *lengthy* criminal history that includes 18 prior convictions for fraud and impersonating federal officers. wusa9.com/article/news/n…
Troy Smocks was actually the felony defendant facing the second-lowest recommended sentence so far. The defendants in orange below are the Oath Keepers who have pleaded guilty so far to #CapitolRiot charges. Smocks has just been sentenced first.

Alright, the sentencing hearing for Troy Smocks is getting started before U.S. District Judge Tanya S. Chutkan. As stated above, if Chutkan hews to the requests from both the DOJ and the defense, it could result in a sentence of time served for Smocks.

In a hearing now before the House Judiciary Committee, Chairman @RepJerryNadler tells AG Merrick Garland it's not enough "just to right the ship," he must also help the country "understand and reckon with the violence and lawlessness" of the last administration.
