One of the judges: "High school students are not exposed to images of guns on a routine basis? They're ubiquitous in our society."
Judge Sykes asks if there's a gun-free school zone sign outside the building, says if "images of firearms appear in other forms in the school, it's hard to argue that seeing it on someone's t-shirt is going to substantially disrupt the learning environment."
School's lawyer says he doesn't know if the schools have gun-free school zone signs.
Sykes asks if the schools teach the Bill of Rights, including the Second Amendment "and there no images ever in the history curriculum of founding-era patriots with muskets?"
Schools' lawyer: "There is nothing in the record to suggest that there are any gun images in the curriculum, posted on walls, or anywhere in either of these schools in this case."
Judge Ripple channels Justice Alito from MN Voters Alliance v. Mansky, asks the schools if a student could wear a t-shirt with the text of the Second Amendment on it. The schools' lawyer simply says "different issue."
Schools' lawyer says students are free to write about guns and the Second Amendment, and that "all that's being banned is the image of the gun."
Schools' lawyer says "AR-15 is known as an assault rifle," says their doctor says that "images of guns affect students" by causing fear and anxiety.
Schools' lawyer says people complained because "the images of the gun had an actual effect" on "many people."

Sykes asks how many students.

Schools' lawyer: I can't tell you if it was 30 or 300.

Sykes: "That's important."

Sykes says it's the schools' burden to know that info.
Judges Sykes and St. Eve are confused as to how the school doesn't know the number of complaining students besides it being "multiple."
Sykes: If this was a serious concern about something being disruptive, "you'd expect the administrators to document it."
Schools' lawyer keeps trying to redirect the argument to the student's other disruptive/concerning behavior. Sykes says that's irrelevant to the facial challenge against the school's policy.
Schools' lawyer closes by saying that "those gun t-shirts interfere with the rights of other students to attend school free of fear, free of anxiety, and not having to look at an image every single day that tells them their school might be the next one that's shot up."
Plaintiffs' lawyer says that he asked the principals in deposition how many students complained, and neither was able to tell him.
Plaintiffs' lawyer says that one of the schools has a trap team, so students are already being exposed to images of other students holding guns.

Judge Hardiman asks NJ what prompted the investigation into S&W's advertising. NJ says it was "several things," including ads that say the company's guns are "the most accurate and reliable."
