A) Graham on if Dems alter the filibuster: There would be an effort to pack the Supreme Court. There'd be an effort to make Puerto Rico and D.C. a state. There'd be an effort to do away with the Electoral College
B) Graham: You need 60 votes under the current rules of the Senate to get on legislation that's called cloture. They're not going to get 60 votes. They're not going to get one Republican.
C) Graham: And that's when Senator Schumer will try to get the parliamentarian, the presiding officer, to change the rules. And what he will do, he will try to make an exception of the legislative filibuster for this one piece of legislation that ever happened.
D) Graham: That's the beginning of the end of the filibuster. The dam will break. And as of this moment, Senator Manchin and Senator Sinema say they will not be part of that
E) Graham: President Trump constantly asked us to change the rules because a lot of things he wanted to do and I want to do, we couldn't get done. And that's that's the price you pay to allow the minority voice to exist

1) Colleague Kelly Phares rpts more than 160 House members have filed paperwork for remote voting today. But there have been multiple positive tests among members just today.
2) The House is slated to conduct a quorum call at 6:30 pm et tonight to conduct a quorum call to formally launch the 2nd session of the 117th Congress.
3) If the House did not have remote voting, put into place after the pandemic, it may struggle to get a quorum to officially start the second session.

1) AG Garland on Capitol riot: As of today, we have arrested and charged more than 725 defendants, in nearly all 50 states and the District of Columbia, for their roles in the January 6th attack. In charging the perpetrators, we have followed well-worn prosecutorial practices.
2) Garland: Those who assaulted officers or damaged the Capitol face greater charges.

Those who conspired with others to obstruct the vote count also face greater charges.”

The actions we have taken thus far will not be our last.
3) Garland: The Justice Department remains committed to holding all January 6th perpetrators, at any level, accountable under law — whether they were present that day or were otherwise criminally responsible for the assault on our democracy.

1) This has the potential to be a donnybrook.

Fox is told that the House Republican leadership isn’t buying the assessment made by US Capitol Police Chief Tom Manger that the force has made significant improvements since the riot last year.
2) One GOP source said it is “very difficult to reconcile” what Manger is saying publicly about security upgrades when it flies in the face with some of what has been said by the USCP Inspector General Michael Bolton.
3) Republicans note that USCP have still not implemented 64 out of 104 security recommendations.

The source suggested that either Bolton isn’t being truthful or Manger isn’t being truthful.

A) From colleague Tara Prindiville. USCP Union Chairman, Gus Papathanasiou: “We’ve never seen a threat environment like this and given the profound division in this country, this may very well be our new normal.”
B) Papathanasiou: “My biggest fear right now is a lack of manpower to meet the rising threat levels. The USCP is authorized to have 2,072 officers. On January 6th we were 233 officers below that level."
C) Papathanasiou: “They are exhausted. The lack of manpower and increased daily mission requirements mean officers now face ongoing 6-7 day work weeks and constant double shifts. Our officers believe in their mission, but there is a breaking point.”

1) In letter sent to Congressional offices, Capitol Attending Physician Brian Monahan tells Capitol hill community that COVID cases "exploded." Says The Capitol's positivity rate went from less than 1% to more than 13%.
2) Monahan: "Dozens of individuals with coronavirus infection are identified at the Capitol daily, with the majority of these occurring in vaccinated individuals." Says 65% of cases are symptomatic.
3) Monahan: "A significant measure to reduce disease spread now includes wearing a properly fitted, medical-grade, filtration face mask (KN95 mask, or better (voluntary N95 mask program) when in crowded outdoor events or when in indoor spaces and another person is present."
