His child had just been rushed to the hospital after a seizure from a nut allergy apparently triggered by the smoothie.

That would be restorative justice - which is about making amends to the impacted: the victims and community.
It isn’t up to me to decide what is enough to ameliorate harm to others. I think they should get a say there.
