Quashing FIR against a man over his Facebook post in which he had called late #CDSGeneralBipinRawat a ‘Dictator’ and ‘mercenary of the fascists’, the Madras HC said that accused’s act was certainly outrageous to moral sense but it did not amount to a criminal offence under IPC.
The bench of Justice GR Swaminathan condemned accused G.Sivarajaboopathi's act in harsh terms but held that his action were not such to invoke Sections 153, 505(2) and 504 of IPC.
Notably, before parting with the matter, Swaminathan J. remarked,
"While the petitioner is entitled to criticize the legacy of the late General, the way he has reacted to the General's death is not in consonance with 'Tamil Culture'." #CDSBipinRawat
"Making an uncivil remark directed against a particular individual in social media in the facts and circumstances of the case would certainly not lead to the situation contemplated by Section 153, IPC," held Madras High Court. @ISalilTiwari with details: lawbeat.in/news-updates/o…
