Yesterday plaintiffs submitted their reply to DHS and ITServe's motions for summary judgment, and included exhibits showing DHS was warned about abuse of the #h1blottery electronic registration system. 🧵
Compete America warned about "flooding the system" with duplicate registrations. They predicted good faith users would be harmed and trust in the lottery system would erode.
Information Technology Industry Council expressed the same concerns about flooding the system with phony applications and asked USCIS to clarify how they planned to prevent fraud.
DHS itself mentioned "flooding" in the H1B electronic registration rule and the only safeguard was the honor system (!). They knew multiple lotteries would have to take place and had no real ideas how to catch fraud. Total incompetence by @USCIS.
Fraud and abuse of the new electronic H1B registration system (including by bodyshops) was mentioned in dozens of other public comments. There is literally no excuse @USCISDirector. The lottery in its current form should be ended before more are harmed.
Zoe Lofgren says a European immigrant with a bachelor's degree will get a green card before a person from India with a PhD and calls it a "racist" system.
Never mind that PhDs are in the vast minority. If she wants merit based immigration, how about banning the H-1B lottery?
Tom McClintock says the bill only benefits immigrants from two countries: China and India and thanks to spillover, India got 35% of available green cards last year.
Of course, we still will have fake universities flogging phony certifications like this one in Houston and its sister fake university in Massachusetts. Evidence suggests both are run out of India as a website / call center scam.
Reading the ruling in this case issued on 2/17, the judge completely slammed @ITServeorg for being wrong about almost every single aspect of the case.
ITServe's case revolves around one of their H1B dependent bodyshops (Saxon Global) which argues they must be allowed to bench their workers and shuffle them around the country without doing any paperwork or paying any fees that hurt their bottom line.
Saxon Global was BAILED OUT by we, the federal taxpayer, to the tune of $2 million dollars. Their "loan" was forgiven which means they don't have to pay back a single cent. And they say they can't afford to pay USCIS a measly couple of bucks... 🙄
@ChuckGrassley#Business and #journalism are unequivocally not "STEM" fields. Berkeley and NYU are simply desperate for international students to pay inflated tuition.
@ChuckGrassley There is no STEM worker shortage in these fields! BLS doesn't even keep statistics on the number of "anthrozoology" jobs. The only reason to classify them as STEM is to justify importing more international students for greedy universities.
@ITServeorg The judge in this case Trevor McFadden is a Trump appointed federal judge. We sincerely hope this judge stays in the DC district court for a long time and issues more rulings like that that benefit Americans, NOT Hyderabad gangsters...
