This could all be false information trying to spin the NYTimes. But the researchers are claiming they were spying on the Obama White House, not the Trump White House, so why take that to CIA in Feb. 2017? 
While Sussmann can claim that he wasn't spying on Trump, these stories were then leaked to the press claiming that these phone calls & the spying occured under Trump.

This is not an indication that Sussmann isn't guilty. He was involved in the effort to illegally spy upon Trump & 7 others, then provide that data to FBI & Baker to make a false narrative that FBI was investigating Trump.
