#SupremeCourt hears a plea by Poultry Farmers Breeders Association challenging a NGT order stating there are no guidelines for such farms to work when they have a capacity of 1 lakh or more birds

Justice DY Chandrachud: The chickens are kept in unhygienic conditions and the droppings create air pollution

Justice Surya Kant: you cannot even stand in 2 km radius of these farms due to the air pollution

Rohatgi: we were asked to revisit the guidelines. Now there are fresh guidelines.

Rohatgi: August 2021, and even that is now challenged

Rohatgi: no notice was issued and no one was heard apart from the petitioner. then an order was passed where the earlier order is reproduced. Guidelines have statutory flavour and it cannot be brushed aside like this

SC: principal grievance that first order of NGT and nor the second order has not heard the representatives of the poultry farms as they were affected by the directions. since the appellants were not before NGT thus we grant liberty to appellants to move NGT seeking modification
