BREAKING: Bombay High Court grants bail to 10 out of 18 accused persons who applied for bail in the Palghar Sadhu lynching case(s). A total of 126 persons have been accused in the case #palgharsadhus
The court had granted bail to those persons who were either assisting the accused to carry out the lynching or instigated them to carry it out. #palgharsadhus
According to the order of #BombayHighCourt the accused sought bail on the ground that #Maharashtra has not been able to compile cogent and reliable evidence against them in the charge-sheet in the #palgharsadhus case.
The order states that the accused as the case of #Maharashtra is that a mob of 400-500 villagers was present at the spot, on the date of the lynching and that the accused expressed doubt about how they could be identified from the mob. #palgharsadhus
The accused further argued that investigation into the offence conducted by the local CID, is in no way, sufficient to implicate them for the offences with which they are charged #palgharsadhus#BombayHighCourt
According to the order Satish Manshinde, the SPP objected to the bail on the ground that the incident is a serious on where a White Eco vehicle was overturned by the mob and three persons, who were proceeding to the funeral of their Guru were killed #palgharsadhus
SPP Manshinde argued that themob turned violent and started hurling stones at the police van, incident took a serious turn and the police had to resort to fire in air to disperse the unruly crowed #palgharsadhus
The #BombayHighCourt then took note of the tabulation of the offences committed by the accused in #palgharsadhus lynching
The #BombayHighCourt while granting bail for some accused notes that the evidence against them establish their presence on the spot, as they are identified by the witnesses. But, they are not attributed any overt act of assault, though each one of them was carrying some weapon
The court notes that “counsel for accused has submited that the applicants are the tribals/aadivasis and it is not uncommon for them to carry a stick/bamboo in their hands and particularly in late night hours, if they are required to move in the village/their hamlet.” #palghar
The accused who have been denied the relief are the ones against whom court noted that their active participation in lynching the #palgharsadhu was noticable in the CCTV footage.
Court noted that they could be seen hitting the deceased sadhu with sticks while in police van.
Denying bail to two of the accused court noted that CCTV footage revealed that the lynched #palgharsadhu was assaulted while he was in the police van till a point of time, he fell on the ground.
