A division bench of Hon'ble Mr. Siddharth Mridul J. and Mr. Rajnish Bhatnagar J. of the #DelhiHighCourt to hear Umar Khalid's bail plea today.
Hearing begins.
Umar Khalid's counsel, Mr. Trideep Pais, begins arguments. Court reads transcript of the speech given by Khalid.
Court asks Mr. Pais to explain Khalid's statement made on the PM to the effect that the PM's statement "Hindustan Mei sab changa si" is far from the truth and that "Hindustan Mei modi Nanga si"
Bhatnagar J. - Is this appropriate to talk about our PM this way?
Bhatnagar J. - Could other words not have been used?
Trideep Pais - Milords this word "Nanga si" does not amount to a terror crime. A lot worse has been said about our heads of state. The finance minister had been called "Napunsak". This cant be said to be an act of terror
Mridul J. - What is the meaning of the words used in the speech such as "inqalab" and "krantikari"? It is not been said "Inqalab zindabad". It is said with the word "krantikari"
Trideep Pais - Irfan Habib, has a podcast on the interpretation of the word "inqalab"
Mridul J. - unless you plan on giving us a history lesson, we dont need to hear the podcast on "inqalab"
Trideep Pais - I have used the word "inqalab" in the context of of the protest milords! By no means were the words inqalab, or krantikari used in the context of violence...+
..+ or terror. It was merely a protest against an unjust law”
Mridul J. - what is the dictionary meaning of the word "inqalab" and "krantikari" ?
Pais - Inqalab means "revolution" a sudden radical or complete change; a fundamental change in political organisation especially..+
..+.. the overthrow or renunciation of one govt or ruler and the substitution of another by the governed"
Mridul J.- “What did Bhagat Singh mean when he used the words ‘inqalab zindabad’?
Pais - A radical change or revolution.
Pais - Milords may also allow me to show the meaning of the word "revolution" during the indian independence movement.
Mridul J. - We are independent! where is the need for revolution now?
Pais - I have used the word "revolution" to call for people to protest and boycott an unfair law. It sits well with the idea of a non violent satyagraha protesting the law.
*Reads out transcript of the speech*
Mridul J. - *pauses Pais at the part where Khalid says "krantikari istaqbal pesh karte hai". What is the meaning of krantkari istaqbal? Possibly Mr. Pais you have lost it in translation
Pais - *reads an article by the Hindu showing how Nehru described himself to be a revolutionary*
Also referred to speech by former PM "India missed the bus when it came to the first 3 industrial revolution, but when it comes to the 4th such bus....+
..+ we have not boarded it but we will drive it"
Mridul J. - That is in context of the "Industrial Revolution"!
Pais - Milords all I am trying to say is that simply using the word "revolution" does not mean violence or terror. There is revolution in engineering, science...
..+ technology, etc. These are not violent calls for revolution. Thoughts of violence, ideas of violence should not be mixed up with the meaning of the word revolution
Mridul J. - *quotes an Urdu poet*; says that for incitement just the people around you do not have to be affected, one can also incite people far away.
Mridul J. - anyway, you need not harp on the "revolution" point further. we have the gist of it. let us start with the charges against you.
Pais - Milords there are 17 charges against me.
*reads chargesheet*
Chargesheet refers to Umar Khalid being the mentor of Sharjeel Imam.
Pais - fertile imagination of the police milords! no evidence of this in any regard.
Also refers to adjectives used for Sharjeel imam as "communal" and other flowery language used in the chargesheet.
chargesheet says that the WhatsApp group was formed on the instructions of Umar Khalid.
Pais - No iota of evidence to this!
Mridul J. - We can stop at the point. Because it seems like it is not convenient to hear this piecemeal on different dates. So what we propose is to hear this matter, Monday onwards everyday post lunch. We would like to finish this matter before court vacation.
Mridul J. - "For further hearing on behalf of the counsel for the parties. List for further hearing on Monday at 2:15"
