In another shocking, anti-Constitutional & lawless ruling, the half-Trump Supreme Court majority finds Americans don’t have the basic rights against false conviction or extralegal execution we have all come to take for granted. apple.news/AAomXCYKETD2hl…
The gravity of this ruling cannot be overstated. The #1stAmendment says Congress shall make no law abridging the right to seek redress, but Thomas ignores this & cites a law he claims denies courts the authority to intervene in miscarriages of justice.
The #6thAmendment guarantees the right to be properly defended by competent counsel, but Thomas ignores this & essentially argues with zero foundation in law that there is simply no need to correct such an injustice.
The evidence in the case makes clear the victim died of an injury that could not have been caused by the defendant, but Thomas ignores this & treats the life, liberty & rights of the defendant as secondary to a twisted legal argument that has no defensible reason for existing.
Yes, this is the same Justice Thomas who cast the lone vote to block release of White House documents to #January6 investigators, after his wife suggested a coup d’etat to the White House. The Court ruled 8-1 against Trump in that case.
This majority opinion marks an alarming & lawless departure by the Court from defense of some of the most essential human rights at the core of our democracy. Thomas has effectively argued that the Court has no responsibility to the innocent & that power can take innocent life.
This should be all the more alarming, given the number of Justices who supported this ruling who also claim to be “pro-life”. This ruling demonstrates without a doubt they are no such thing & that their anti-abortion views are about denying individual rights.
The monstrous #AlitoDraft in the Dobbs case similarly seeks to ignore or overrule much of the Bill of Rights, to make a legally baseless argument that women can be forced by the state to use their bodies for a purpose decided by a panel of judges or other unaccountable officials.
If either of the Presidents Bush or Donald Trump ever told you they believe in your freedom, the justices they sent to the Supreme Court are telling you that your rights have no meaning to them & will not be defended.
This bizarre & again grossly unprofessional document, full of false claims, seductively ignoring Constitutional protections, federal law & judicial precedent, shows the same amoral disregard for the responsibilities of a Justice & for the lethal ramifications of bad rulings.
Thomas writes, incomprehensibly, that “if a prisoner has ‘failed to develop the factual basis of a claim in State court proceedings,’ a federal court ‘shall not hold an evidentiary hearing on the claim’…” even if the fact is the “prisoner” is innocent & the prosecution lied.
The instruments of power in the US are constrained by the obligation to operate in service of the rights of all. Thomas would discard the Constitution & this foundation of its legitimacy in exchange for the arbitrary claims of autocratic, undisciplined & dishonest power-holders.

@JohnCornyn If you’re interested in what we can do: Ban combat weapons & assault rifles, permanently; enact legislation to make arms traffickers at all levels personally criminally liable if they sell automatic weapons or any weapon without a waiting period, license & background checks.
@JohnCornyn Call for an independent criminal investigation into the use of dark money from arms traffickers to coerce, threaten & influence elected officials to prioritize their profiteering from mass murder over the right of Americans to live free from terror & bloodshed.
@JohnCornyn Join with Americans, including schoolchildren, who are protesting these endless massacres & the gun industry that generates them & publicly demand that the NRA cancel its event in Houston, to honor the lives lost & commit to 100% withdrawal of all opposition to #GunSafety laws.
Samuel Alito is attempting to use the power of the Supreme Court to erase the personhood of women in the United States. He is attempting to void the right to remedy & redress. He is declaring war on American democracy & the right of all Americans to be free from arbitrary abuse.
When Alito argues that unenumerated rights are not protected by the Constitution. The #9thAmendment—which explicitly protects unenumerated rights—says Alito is absolutely unfit to serve on the Supreme Court.
Samuel Alito testified under oath in his confirmation hearings that the Roe decision “deserves to be protected”. This was clearly a lie under oath. That lie was used to take a seat on the Court. That crime is currently ongoing.
Samuel Alito, by writing this ruling, has taken the side of those who align with child rapists over their victims. He has affirmed his willingness to end women’s lives rather than save them by terminating a pregnancy they cannot survive…
Any person who professes any kind of support for this perverse, inhuman “opinion” drafted by Alito is signing up to those same things: forcing a raped child to give birth & killing a woman who could be saved. Alito is also declaring his willingness to nullify basic human rights.
Any elected official who supports this decision is publicly stating that they cannot & will not honor their oath of office, which requires them to put the rights of Americans ahead of their quest for power. This ruling sets a precedent that could erode other basic rights…
This news, if true, is evidence of an extremist, anti-democracy takeover of the United States Supreme Court. For decades, wealthy interests have claimed their funding would “place on the Court” a group of judges bent on stripping away a Constitutionally protected right.
The stripping away of this right is an overt act of cruelty toward women. By doing this, the majority joining this opinion also degrades the sanctity of the most basic human rights of every American, questioning whether any person can have sovereignty over their own body.
And that is exactly the point. This cruel attack on the rights of women creates a precedent whereby ideological extremists, beholden to a wealthy elite, can use the powers of the Court to strip away basic Constitutional rights, subverting the right to remedy.
@atrupar The absolute moral decay of Fox News is beyond belief. Putin is a corrupt dictator who assassinates & jails critics, torments his fellow Russians & has been waging cyber war against the United States & our democracy, but Fox pays a fortune to “personalities” that cheer for him.
@atrupar Also, when Hannity talks about “the media mob”, how can any person in their right mind not understand that he is more an example of that than virtually anyone? His nonstop harassment, defamation & zealotry seem very much like a strategy of radicalization & incitement.
@atrupar And beyond that... this endless yelling about nonexistent “radical socialism” by extremists who never present any evidence other than “because I yelled it”... how can anyone not see they are simply deflecting from the autocracy & corruption they celebrate?
Trump lawyer Van der Veen gives reasons for acquittal: 1) jurisdiction 2) Rule 23 (each allegation as separate article) 3) due process 4) First Amendment
He doesn’t mention innocence as a possibility. #VoteToConvict
On reason 1) Jurisdiction: The Constitution requires a Senate trial. Trump was impeached while in office, for actions committed while in office, so that question is moot. The Senate voted to recognized its jurisdiction & ALL 100 SENATORS swore to serve as jurors.
On reason 2) Rule 23 - The argument that Trump did so many things wrong he must be acquitted because there is only one article is nonsense & shocking. The other crimes are provided as evidence of the core crime, both of Trump’s state of mind & ongoing intent.
