For the HHS Secretary to declare a PHE, there must be a finding that a disease, disorder, significant outbreak of infectious diseases, or bioterrorist attack exists. PREGNANCY IS NONE OF THESE...
Not even the most liberal Democrat who voted for the Public Health Service Act (which authorizes PHEs) ever imagined it as a tool for Presidents to throw a temper tantrum because SCOTUS said some states could stop the murder of unborn babies...
PHEs would absolutely not allow HHS, the White House, or Attorney General to preempt state laws prohibiting abortions (though they've already said they're going to try with medication abortions, even absent a PHE)...
I doubt any serious person in the Biden Administration believes this would do anything other than show action to their extremist base, but they should think about the precedent: if PHEs can be used by Democrats to allow abortions, could Republicans use a PHE to outlaw them?...
Think about it. PHEs are meant to save lives. Elective abortions have killed hundreds of thousands of babies each year for decades. A PHE that stopped that would save more lives than any previously issued PHE in history.
