SC's constitutional bench rules on selecting CEC & EC!

Sr Adv Harish Salve was said it right in 2014 about how the ecosystem attempts to destabilize the Govt.

Is the judiciary trying to interfere in Govt's matters?

This day, the 5 bench judges I.e. constitutional bench consists of Justice KM Joseph orders on the process of appointing the Election Commissioners (EC).

They ordered, that EC will be appointed by the President of India on the advice of committee. 2/n

• What is the committee?
• Who are the high profiles in that?

In said committee that will advice President consists of PM of India, Chief Justice of India and lastly the Leader of Opposition in LS (or) party with max seats, and it is till Govt enact law.

One of the judge in the constitution bench, Justice KM Joseph has already wanted the CJI to be selection process of CEC and EC.

Soon after the verdict came out, the oppositions says it's victory for them.

Really?

Of course not, the reason is very simple and clear, the tenure for present CEC is until 2025 and other ECs will be next to assume office of CEC. 5/n

Now various questions being raised that, why the executive could not interfere in the appointment of CJI that is in Collegium?

Also why the SC not interested to restructure the appointment of CJI Judges through NJAC? 6/n

At different times, the Vice President, and the Central Law Minister made it very clear that there should be a legal system in replace of Collegium.

The matters comes with the petition who filed this and how the court acts. 7/n

At one point, Law Minister had called the "Collegium a Alien".

Also he wrote a letter to CJI to include the representatives of State and Centre to appoint Judges in SC & HC. 8/n

Initially this debate was sparked after Justice KM Joseph asked Govt of India to give him the docs related to appointment of EC Arun Goel and also demanded CJI to be in selection process of CEC so that it becomes a transparent. 9/n

In response to that the Govt representatives made such statements in public and in response the Judges had also commented on VP and Min's view on collegium and hard words on it. 10/n

The act of Oppositions by filing the Petitions through their parasites in which they demands for the restructure of institutions that are not done during Cong rule for almost 6 decades, confirms the words of Sr Adv Harish Salve is true. 11/n

Will the Govt once again visit the NJAC, and takes steps to implement which will make the transparency in the appointing and elevating the judges, that was earlier nullified by the same SC in 2015?

But it's the high time.. 12/n
