Missing words from Attorney General Garland's speech in #Ukraine:

"International Criminal Court"

Why?

Especially given the #U4J speech was on U.S. support for prosecution of Russian #WarCrimes.

So why the omission?

The reason is pretty scandalous.

2. The root cause may not be in the Justice Department at all, but rather coming from the Department of Defense.

See @charlie_savage's earlier reporting.

3. Here are A.G. Garland's remarks:

4. It is extraordinary intransigence by Biden team given unusually strong bipartisan Congressional push for U.S. support to International Criminal Court's #Ukraine investigation, including passing recent legislation.

Leaders on the issue include: @LindseyGrahamSC @SenatorDurbin
5/5. Finally, some more background.

I wrote this in April 2022 collecting all the bipartisan legislative support at the time (and there's a lot of it).

Jim Jordan’s first “whistleblower”:

Steve Friend, former FBI agent suspended “for objecting to using a SWAT team to arrest a subject for what Friend described as ‘misdemeanor offenses.’”

Who were the arrestees that day?

Three Percenters who attacked the Capitol👇❗️
2. Here’s the CNN report connecting Jim Jordan’s “whistleblower” (media needs to put that in scare quotes) who appears to have been actually suspended because of his refusal to assist in the SWAT team arrest of the alleged militia group members:

Needed: An FBI Director who'll conduct a true review of FBI's #January6th intelligence failure.

New GAO Report👇

"The ongoing FBI review of its actions during the weeks preceding January 6, 2021 has NOT INCLUDED an assessment of how it processed information."

It begins

Fulton County, Georgia special grand jury has recommended the indictment of multiple people.

Forewoman of the jury speaks on the record.

“You’re not going to be shocked. It’s not rocket science.”

nytimes.com/2023/02/21/us/…
2. “We definitely started with the first phone call, the call to Secretary Raffensperger that was so publicized.”

“I will tell you that if the judge releases the recommendations, it is not going to be some giant plot twist.”
3/3. “You probably have a fair idea of what may be in there. I’m trying very hard to say that delicately.”

Quotes from interview with special grand jury forewoman on the record.

Want to understand legal weaknesses _and_ strengths of Pence’s Speech & Debate Clause claim?

I discussed @OutFrontCNN how DOJ has taken position that Speech & Debate clause includes VP on Jan. 6.

But Pence, at most, could argue only some questions before grand jury are covered.
2. Here’s the August 2021 Department of Justice brief I mentioned on CNN:

DOJ took the position that Pence was acting within scope of Speech & Debate Clause in counting votes as President of the Senate on Jan. 6.

3. Credit to @kyledcheney and @joshgerstein who surfaced the 2021 DOJ brief and another DOJ brief in 2019 when they published their scoop that Pence planned to make the Speech & Debate Clause argument.

Exceptionally important to law of armed conflict.

An opportunity for @DeptofDefense to correct key problems in its Law of War Manual.

Most impressive letter by @SenatorDurbin @RepSaraJacobs.

I'm also gratified seeing so many references to work we've been doing @just_security ImageImageImageImage

Pence v. Pence

Refuse testify b4 Congress:

"Cheney said she understands Pence has expressed concerns over executive privilege"

Refuse testify w/ grand jury:

"Pence is set to argue that his former role as president of the Senate—therefore a member of the legislative branch"
2. Here's Pence on @FaceTheNation claiming his role in executive branch precludes him giving testimony to Congress:

"Congress has no right to my testimony. We have a separation of powers under the Constitution of the United States. And I believe it would cbsnews.com/news/mike-penc…twitter.com/i/web/status/1… Image
