Bombay High Court is hearing Adv GUNRATAN SADAVARTE's plea against initiation of disciplinary action by the Bar Council of Maharashtra and Goa for objectionable statements in the Media.
Justice - This complaint is in parts. One is about the media, but that is indeterminative because we don't know where the bites were given. Ie. Outside the gates of the HC or inside.
J Patel says Sadavarte can face inquiry.
"We are extremely reluctant to be an overseer of the Bar Council."
J Patel says that Sadavarte may claim there are other factors for the complaint against him but he is not alone. There are several other pending cases.
J Patel - If this is not done within a year by Maharashtra the enquiry anyway shifts to Delhi. But that doesn't mean if there is a complaint..(it shouldn't be dealt with).
Adv Subhash Jha - My submission is the complaint has been filed by someone who has nothing to do with this. The complainant is in Pune, I am here. It has to be thrown out on the threshold.
Adv Subhash Jha says he would show malafides - Section 35 of the Act is regarding a lawyer and client dispute.
J Patel - A: We are not inclined to stay the proceedings.. we will not takeover that jurisdiction just because the petitioner believes it has political colour.

J Patel - That has nothing to do with this inquiry which is signed by a member of the Bar Council
J Patel (raises his voice) - We are not going to allow you to open the canvas against the Bar Council like this.
We won't give any special treatment because the petitioner before us happens to be an advocate. That only makes the matter stricter.

Delhi High Court restrains Income Tax authorities from acting on the Show Cause notice issued to Rajya Sabha MP and senior lawyer Kapil Sibal on March 11, 2023 in relation to assessment proceedings.
The court said the concerned officer will first dispose of objections preferred by Sibal. "In this context, the concerned officer will issue a notice to the petitioner which would indicate the date, venue and time of the hearing," said the court.
The concerned officer will pass a speaking order qua the objections preferred by the petitioner and a copy of the same will be furnished to the petitioner, a division bench of the court said in the order.
