1) I am disturbed by the proposed Criminal Justice (Incitement to Violence or Hatred & Hate Offences) Bill 2022. The Bill removes the presumption of innocence for individuals charged under new hate speech laws & presents significant constitutional concern. #Ireland#HateSpeech
2) In law, this is called a ‘reverse evidential burden’. The introduction of a 'reverse evidential burden' in Part 2 S10(3) is particularly troubling & is repugnant to the Irish Constitution. It should be challenged in the courts.
3) The presumption of innocence is a fundamental principle of the Irish legal system, enshrined in both common law and the Constitution. Article 38.1 of the Irish Constitution states that "no person shall be tried on any criminal charge save in due course of law."
4) Removing the presumption of innocence contravenes this constitutional guarantee and undermines the integrity of the legal system. The right to a fair trial is a core principle of the Irish Constitution, protected under Article 38.
5) By placing the burden of proof on the accused, the Hate Speech Bill effectively denies them their constitutional right to a fair trial. The Irish Constitution guarantees the principle of equality before the law under Article 40.1.
6) The reverse evidential burden in the Bill creates a discriminatory distinction between individuals charged under hate speech laws & those charged under other criminal laws. This distinction is arbitrary & unjustifiable, violating the constitutional guarantee of equality.
7) The proportionality principle requires that any interference with an individual's constitutional rights must be necessary, appropriate, and proportionate to the legitimate aim being pursued.
8) In the context of this Bill, while the aim of combating hate speech may be legitimate, the reverse evidential burden constitutes a disproportionate infringement of the accused's constitutional rights. Alternative, less intrusive measures could be employed.
9) Although not part of the Irish Constitution, the ECHR has been incorporated into Irish law through the European Convention on Human Rights Act 2003.
10) Article 6(2) of the ECHR enshrines the presumption of innocence, and the European Court of Human Rights has consistently held that reverse evidential burdens can violate this principle.
11) As Irish courts are required to interpret domestic law in light of the ECHR, the Hate Speech Bill's reverse evidential burden is likely to be found incompatible with the Convention.
12) The reverse evidential burden in the proposed Hate Speech Bill raises serious constitutional concerns, violating the presumption of innocence, the right to a fair trial, the principle of equality, & the proportionality principle. The provision is repugnant to the Constitution

Ryan Casey, boyfriend of Ashling Murphy delivered a poignant and emotional victim impact statement.
Ashling and I first met on 6 September 2013 at local rugby club disco. 10 years ago this year. we were both just 15 years old. I knew even way back then there was something so special about her.
"The very next day I couldn't resist. I felt something so genuinely so special about her i just had to text her. A number of weeks passed and we were in a relationship with each other. We texted each other every day non-stop. We'd even spend 5 to 6 hours on the phone with each other."
"I'd been at her house for the first time Feb 2014 when I met her family for the first time. I instantly loved her family. They symbolise everything that is good and great about society. I'm so lucky to call them family.
"Deep down we both knew we still both really liked each other. All this time we weren't technically together but we stayed in contact. I had a minor hurling dinner dance in Feb 2016.
"Being out with all my teammates having a great time I was there texting Ashling all night. I made the best decision I've ever made in my entire life, decided to get into a taxi without telling anybody. Tunnel vision for one thing only, that was to ring Ashling tell her exactly how I felt.
"I told her everything. We were destined to be soulmates. By the 28th October 2016 Ashling officially met my parents and my sister.
"This was the real beginning. Although I found out on 18 December 2016 I wasn't officially her boyfriend as I hadn't officially asked her. So on that night I officially asked her. I had a surprise gift to give her for Christmas. A rose gold watch with a brown leather strap.
"A watch that she practically never took off and a watch her mother wears every day." "It was quite simply heaven on earth. I never could have imagined falling for someone so quickly and at such a young age. What we had was very special. We both knew it."
There was nothing I loved more than cheering her up when she was having a bad day. We never had one single argument which is something I loved about our relationship. We both loved each other and respected each other so much to even consider having an argument

"Proposing to her, getting married. The list just goes on and on. We had planned to move to Galway in 2022. After this year we had planned to move to Dubai for 1 or 2 years as it was always Ashling's dream as long as I knew her to teach in Dubai.
"We had plans of setting up a joint bank account so we could get started...we often discussed how many kids we'd love to have and how they'd make little hurlers camogie players and even better musicians.
"In terms of marriage there was just no question.... I was going to marry the girl of my dreams. And my soulmate. We would talk about the wedding day itself and all the fine details of what that day would be like.
"Even down to our wedding song, which Ashling always wanted it to be Can You Feel the Love Tonight from the Lion King. When I used to drive home from her house I always every single time without fail smiled to myself and would say I can't wait to marry that girl some day.
"I wish I did. We just didn't get our chance. I lost my partner in life, my closest friend, my best friend.
"A role model for my little sister, future grandchildren for my parents. Everything I ever wanted in life is now gone and cannot be brought back. Ashling was simply everything to me. I simply lost everything.
"I never knew there was a pain as severe as the physical and emotional pain that comes with losing the most important person in your life - especially in such an evil act by such an insignificant lowest of the low waste of life."

2/ The Bill is 4 parts: Part 1 deals with definitions & the meaning of protected characteristics. Part 2 provides for new offence of incitement to violence or hatred. Part 3 creates new, aggravated forms of certain existing criminal offences. Part 4 deals with amendments.
3/ Part 1 Section 2 – is titled “Interpretation”. It states hatred means “hatred against a person or a group of persons in the State or elsewhere on account of their protected characteristics or any one of those characteristics”, but the bill does not define what hatred is.
