ED knew that its money laundering investigation in Chhattisgarh liquor case will be quashed as it was initiated based on Income Tax Act proceedings without any predicate offence.

So, ED chose to create a predicate offence to continue with its probe.

Hemant, Deputy Director in ED filed a complaint with Noida Police alleging irregularities in printing of holograms for liquor bottles sold by Chhattisgarh Excise Department and a FIR invoking scheduled offence under PMLA was registered by UP Police on 30.7.2023.


There has to be a predicate offence (FIR with schedule offence) for ED to initiate money laundering investigation.

In cases where there are no predicate offences but if ‘politics’ warrant an investigation, ED created predicate offences by filing FIRs in BJP ruled States (sans territorial jurisdictions).
