New in @GenFlynn case—the judge will set a date for a motion hearing at which the motion to produce exculpatory evidence will be considered.
@GenFlynn Judge Emmet G. Sullivan will use "the standard set forth in United States v. Yunis".

Summary of the Yunis case here: courtlistener.com/opinion/518376…
@GenFlynn The Yunis case has elements which echo the @GenFlynn situation.

Specifically, the defense requested "any tapes or wire taps", including "any intercepted wire, oral or electronic communications, mobile tracking devices, pen registers and trap and trace devices."
@GenFlynn In the most recent filing, @SidneyPowell1 alleged that @GenFlynn was the target of illicit surveillance.
@GenFlynn @SidneyPowell1 The DC Circuit ruled against Yunis, finding that the lower court shouldn't have ordered the disclosure of classified info to the defense because the evidence was "not helpful to the presentation of the defense or essential to the fair resolution of the cause."
@GenFlynn @SidneyPowell1 Fawaz Yunis is a Hezbollah terrorist hijacker. He was convicted and sentenced to 30 years in prison.

People rooting for @GenFlynn will probably be irked to learn that the standard set in this terrorist's case will be used to resolve Flynn's request to disclose exculpatory info.
