Major Ty Miller now taking the stand. She is with the Greenville County Sheriffs Office.
She has worked with the office for a little over 20 years. Says she is part of the command staff. Reports directly to the sheriff.
Says she first met Nabors during the transition just a few months before Lewis took office. Says they had meetings to determine what the structure would be once he took office. Says Lewis put the team together.
Miller says they would meet at several different places. Says Lewis had an office in County Square, separate from the LEC. Miller says her office was also in County Square since she was part of a specialized division.
She says there is plenty of space in County Square and says it has multiple conference rooms. Now talking about relationship between Nabors and Lewis. Said they had never had a sheriff with a personal assistant.
Says the relationship between Lewis and Nabors was "giddy and silly." She says it was odd and that she would call him by his first name. Says he told her that orders or instructions from Nabors were the same as if they came from him. Says this was odd since she was a civilian.
Says when Nabors got a new car this was contentious throughout the office. Says Nabors also got a cell phone, parking spot, says it was clear that they were a team and that "one came with the other."
Miller says since Nabors' position was new no one really knew what to expect from it. Says she knew it was "tough on morale." Says Lewis asked her to look out for Nabors. Says he told her he "told the guys she was off limits to them."
Miller now talking about an officer involved shooting that happened. Says the command staff will respond and support that officer. Says when she responded to the scene Lewis pulled up to the scene with Nabors in the car. Says someone said "what is going on."
Says she later confronted Lewis about allowing Nabors' into that crime scene. Says this likely happened a couple days later. She talks about the importance of preserving a crime scene. Says she told Lewis it didn't look good to take an assistant into a crime scene.
Miller said she told Lewis that "perception is reality" and said he told her he would "create distance." Moving onto the Charlotte trip now. Says she knew about the trip but did not know Nabors was going.
Says on the way back Lewis had called Miller and said Nabors had gotten really drunk the night before. Says Lewis asked her not to tell the others in the office. Miller says she didn't see a need for Nabors to have gone on the trip.
Miller says Nabors had contacted her on a Saturday later on saying she needed to talk to her about something. Says they met at Panera to eat and then planned to walk the Swamp Rabbit together. Says she contacted Davenport (her supervisor) to fill her in.
Says Davenport told her to tell Lewis in case Nabors told him later. Miller reached out to Lewis and asked Miller to tell him what happened after she met with Nabors. Says he said he needed to know if she was returning to her position or not.
Miller say Lewis told her not to offer Nabors a position under her calling it a "lack of understanding of law enforcement." Miller says at the time she agreed with Lewis saying she felt if Nabors wanted to leave they should let her.
Miller says when she met with Nabors she started talking about how she was separated from her husband. Says this happened at Panera and Nabors didn't want to talk about her other issues there, waited for on the walk.
Says they drove to the trail together and Nabors said she needed to talk to her about Lewis. She asked Nabors if they were sleeping together, she said no but that they had kissed. Miller says she began looking at this from a supervisor standpoint.
Says Nabors played the tape about going to Reno for her. She's now describing the tape and how Lewis said beat partners would undress in front of each other. Nabors asked if this was normal, Miller told her no. Said this was "pure manipulation."
Says when she heard what Lewis had said about her she felt angry and disrespected. Says during that walk she decided she would not allow Nabors to work under Lewis anymore. Talked about moving Nabors to work under her at County Square.
Miller says she was overwhelmed and that the situation was much different than what she was. Says she was really unhappy with the fact that Lewis put Nabors in this situation. Says Nabors was really vulnerable and impressionable.
Miller says she told Nabors that Lewis knew they were meeting. Says Nabors said she was quitting on Monday anyway. "I was going to protect her as much as I could."
Miller now saying if they went to the event in Reno that that would have been paid for with taxpayer funds. Says she found out about the sexual nature of the relationship when Nabors posted the blog. Says Lewis denied having sex with Nabors at the time.
Said eventually Lewis admitted to having sex with Nabors once. Says she told him it was important to "get out ahead of it." Says Lewis said he would not do that because his wife would leave him.
Now moving back to Nabors quitting. Miller says she offered to go with Nabors to quit and help facilitate between her and Lewis. Says she checked on her after and says she felt sorry for her.
Miller now talking about hiring the replacement for Nabors. Says they were not involved in the hiring of Nabors, says it was a new position. Says there was a "blonde Tennessee beauty queen in food service" who he wanted to hire for the position. Miller told him "absolutely not."
"Without integrity how do you do what we do." says Miller. "If you have no integrity you shouldn't be in law enforcement."
We are now on cross examination. Wise asking questions about Nabors expressing that she didn't like the long hours of the job and that it wasn't what she thought it was. Wise asks if Nabors told her the kiss was unwanted. Miller says no, just that it happened.
Miller says initially she thought they were sleeping together. Says it was the logical conclusion after putting the pieces together. Says Nabors told her she wasn't afraid of Lewis.
Miller says she was not a supporter of Lewis when he ran for office. Says she and Lewis were known to be polar opposites. Says Lewis kept her on and promoted her. Says she thinks he kept her on for accountability.
Quick re-direct on Miller. She says she would consider what she heard on the tapes a hostile work environment. Now onto recross.
Says she did not know at the time the purpose of the tapes. Miller is dismissed.
