Twitter “experts” are saying the President is threatening to adjourn Congress JUST if they don’t vote on his nominees. But that is not the precise the constitutional argument the President articulated. /2
Article II, Sec. 3 says the President "may, on extraordinary Occasions, convene both Houses, or either of them, and in Case of Disagreement between them, with Respect to the Time of Adjournment, he may adjourn them to such Time as he shall think proper" /3
If the Senate agrees to adjourn and the Dem House stalls and plays politics, Article II, Sec. 3 is triggered because the two Houses would be in a disagreement as to the time of adjournment, and the President can is tiebreaker for time of adjournment. /4
Article I, Section 5, Clause 4 says both Houses must consent to adjournment, so if the Dem House seeks to block recess appointments by not allowing the Senate to adjourn for more than three days, the Constitution gives POTUS power to fight this political gaming. /5
The President is wisely, properly, AND CONSTITUTIONALLY calling on the Senate to either vote on his nominees or formally adjourn, and if the House refuses to adjourn, in that instance he can adjourn them. In other words, do your job and vote or get out of the way. /fin
