Misconduct in public office is an offence at common law triable only on indictment. It carries a maximum sentence of life imprisonment.

2. It is an offence confined to those who are public office holders and is committed when the office holder acts (or fails to act) in a way that constitutes a breach of the duties of that office.
3. The offence is committed when:

a public officer acting as such;
wilfully neglects to perform his duty and/or wilfully misconducts himself;
to such a degree as to amount to an abuse of the public's trust in the office holder; without reasonable excuse or justification.
4. Public officers carry out their duties for the benefit of the public as a whole. If they neglect or misconduct themselves in the course of those duties this may lead to a breach or abuse of the public's trust.
5. Misconduct in public office is a crime. Members of the public can report anyone they suspect of committing the crime to the police. If you feel one or more members of the government or its advisers might have committed misconduct in public office...
6. ...write to your local chief constable asking him or her to investigate the person concerned, setting out your reasons why there are grounds to believe they might have committed misconduct in public office.
7. One might for example argue that a herd immunity policy in response to a virus for which there was no evidence of immunity was, at the very least, wilful neglect. If you make a complaint, it is not your responsibility to prove the offence.
8. It will be up to the police to decide whether there are grounds for an investigation. The Crown Prosecution Service will then take a view on whether to prosecute. If crimes have been committed during the UK’s pandemic response the police have an obligation to investigate.
9. If there are cases to answer, a court of law is the proper place to determine whether a crime has been committed with full disclosure of ALL relevant evidence.

11. Write to your local Chief Constable identifying the individual you believe has committed the offence, why you believe they have committed the offence, and asking for an investigation to ascertain whether a crime has been committed.
12. Don’t be tempted to dismiss it as pointless. I’m aware of at least one active police investigation into a senior member of the government’s #COVID19 response team. This is a serious crime and the police are obliged to treat it as such.
